AMENDMENT TO SENATE BILL 2173

2     AMENDMENT NO. ______. Amend Senate Bill 2173 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Pension Code is amended by
5 changing Sections 16-163 and 16-164 as follows:
 
6     (40 ILCS 5/16-163)  (from Ch. 108 1/2, par. 16-163)
7     Sec. 16-163. Board created. A board of 11 13 members
8 constitutes the board of trustees authorized to carry out the
9 provisions of this Article and is responsible for the general
10 administration of the System. The board shall be known as the
11 Board of Trustees of the Teachers' Retirement System of the
12 State of Illinois. The board shall be composed of the
13 Superintendent of Education, ex officio, who shall be the
14 president of the board; 4 6 persons, not members of the System,
15 to be appointed by the Governor, who shall hold no elected
16 State office; 4 persons who, at the time of their election, are

1 teachers as defined in Section 16-106, elected by the
2 contributing members; and 2 annuitant members elected by the
3 annuitants of the System, as provided in Section 16-165.

6     Sec. 16-164. Board - appointed members - vacancies. Terms
7 of office for the appointed members shall begin on July 15 of
8 an even-numbered year, except that the terms of office for
9 members appointed pursuant to this amendatory Act of the 96th
10 General Assembly shall begin upon being confirmed by the
11 Senate. The Governor shall appoint 2 3 members as trustees with
12 the advice and consent of the Senate in each even-numbered year
13 who shall hold office for a term of 4 years, except that, of
14 the members appointed pursuant to this amendatory Act of the
15 96th General Assembly, 2 3 members shall be appointed for a
16 term ending July 14, 2012 and 2 3 members shall be appointed
17 for a term ending July 14, 2014. Each such appointee shall
18 reside in and be a taxpayer in the territory covered by this
19 system, shall be interested in public school welfare, and
20 experienced and competent in financial and business
21 management. A vacancy in the term of an appointed trustee shall
22 be filled for the unexpired term by appointment of the
23 Governor.
24     Notwithstanding any provision of this Section to the
25 contrary, the term of office of each member of the Board

1 appointed by the Governor who is sitting on the Board on the
2 effective date of this amendatory Act of the 96th General
3 Assembly is terminated on that effective date. A trustee
4 sitting on the Board on the effective date of this amendatory
5 Act of the 96th General Assembly may not hold over in office
6 for more than 60 days after the effective date of this
7 amendatory Act of the 96th General Assembly. Nothing in this
8 Section shall prevent the Governor from making a temporary
9 appointment or nominating a trustee holding office on the day
10 before the effective date of this amendatory Act of the 96th
11 General Assembly.
