| AN ACT concerning safety.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Environmental Protection Act is amended by |
| 5 |
| adding Section 22.23c as follows:
|

| (415 ILCS 5/22.23c new) |
| 7 |
| Sec. 22.23c. Vehicle wheel weights. |
| 8 |
| (a) In this Section: |
| 9 |
| "New vehicle" has the same meaning as ascribed in |
| 10 |
| Section 1-148.4 of the Illinois Vehicle Code. |
| 11 |
| "Vehicle" has the same meaning as ascribed in Section |
| 12 |
| 1-217 of the Illinois Vehicle Code. |
| 13 |
| (b) On and after January 1, 2012, no person shall use a |
| 14 |
| weight or other product to balance a vehicle wheel or tire if |
| 15 |
| the weight or other product contains mercury that was |
| 16 |
| intentionally added during the manufacturing process or |
| 17 |
| contains more than 0.1 percent lead by weight. |
| 18 |
| (c) On and after January 1, 2012, no person shall sell, |
| 19 |
| offer to sell, distribute, or offer to distribute a weight or |
| 20 |
| other product for balancing a vehicle wheel or tire if the |
| 21 |
| weight or other product contains mercury that was intentionally |
| 22 |
| added during the manufacturing process or contains more than |
| 23 |
| 0.1 percent lead by weight. |
