1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Section
5 14C-12 as follows:
 
6     (105 ILCS 5/14C-12)  (from Ch. 122, par. 14C-12)
7     Sec. 14C-12. Account of expenditures; Cost report;
8 Reimbursement. Each school district shall keep an accurate,
9 detailed and separate account of all monies paid out by it for
10 the programs in transitional bilingual education required or
11 permitted by this Article, including transportation costs, and
12 shall annually report thereon for the school year ending June
13 30 indicating the average per pupil expenditure. Each school
14 district shall be reimbursed for the amount by which such costs
15 exceed the average per pupil expenditure by such school
16 district for the education of children of comparable age who
17 are not in any special education program. At least 60% of
18 transitional bilingual education funding received from the
19 State must be used for the instructional costs of transitional
20 bilingual education.
21     Applications for preapproval for reimbursement for costs
22 of transitional bilingual education programs must be submitted
23 to the State Superintendent of Education at least 60 days

1 before a transitional bilingual education program is started,
2 unless a justifiable exception is granted by the State
3 Superintendent of Education. Applications shall set forth a
4 plan for transitional bilingual education established and
5 maintained in accordance with this Article.
6     Reimbursement claims for transitional bilingual education
7 programs shall be made as follows:
8     Each school district shall claim reimbursement on a current
9 basis for the first 3 quarters of the fiscal year and file a
10 final adjusted claim for the school year ended June 30
11 preceding computed in accordance with rules prescribed by the
12 State Superintendent's Office. The State Superintendent of
13 Education before approving any such claims shall determine
14 their accuracy and whether they are based upon services and
15 facilities provided under approved programs. Upon approval he
16 shall transmit to the Comptroller the vouchers showing the
17 amounts due for school district reimbursement claims. Upon
18 receipt of the final adjusted claims the State Superintendent
19 of Education shall make a final determination of the accuracy
20 of such claims. If the money appropriated by the General
21 Assembly for such purpose for any year is insufficient, it
22 shall be apportioned on the basis of the claims approved.
23     Failure on the part of the school district to prepare and
24 certify the final adjusted claims due under this Section may
25 constitute a forfeiture by the school district of its right to
26 be reimbursed by the State under this Section.
