| 2 | AMENDMENT NO. ______. Amend Senate Bill 3747, on page 3,
by | ||||||
| 3 | replacing line 22 with "a covenant or declaration;"; and
| ||||||
| 4 | on page 4, by replacing line 3 with the following: | ||||||
| 5 | "association or its authorized agent; or | ||||||
| 6 | "(8) Any fee, charge, assessment or other amount | ||||||
| 7 | payable to an entity exempt from taxation under Section | ||||||
| 8 | 501(c)(3) of the Internal Revenue Code whose purpose | ||||||
| 9 | includes the conservation of land, natural areas, open | ||||||
| 10 | space or water areas or the preservation of native plants | ||||||
| 11 | or animals, biotic communities or geographic formations | ||||||
| 12 | located within the same subdivision or planned unit | ||||||
| 13 | development or within one-half mile of the real property to | ||||||
| 14 | which the transfer fee covenant attaches for the exclusive | ||||||
| 15 | or non-exclusive use and benefit of the owners of that real | ||||||
| 16 | property.".
