SENATE RESOLUTION

 
2     WHEREAS, The federal "Freedom of Choice Act" would
3 invalidate any "statute, ordinance, regulation, administrative
4 order, decision, policy, practice, or other action" of any
5 federal, state, or local government or governmental official
6 (or any person acting under government authority) that would
7 "deny or interfere with a woman's right to choose" abortion, or
8 that would "discriminate against the exercise of the right ...
9 in the regulation or provision of benefits, facilities,
10 services, or information"; and
 
11     WHEREAS, The federal "Freedom of Choice Act" would nullify
12 any federal or state law "enacted, adopted, or implemented
13 before, on, or after the date of (its) enactment" and would
14 effectively prevent the State of Illinois from enacting similar
15 protective measures in the future; and
 
16     WHEREAS, The federal "Freedom of Choice Act" would
17 invalidate more than 550 federal and state abortion-related
18 laws, laws supported by the majority of the American public;
19 and
 
20     WHEREAS, The federal "Freedom of Choice Act" would
21 specifically invalidate the following common-sense, protective
22 laws and rules properly enacted by the State of Illinois:

1         (1) born alive infant protection (5 ILCS 70/1.36);
2         (2) ambulatory surgical treatment center regulation
3     (210 ILCS 5/Act) and 77 Ill. Adm. Code 205.330, 205.540
4     (codifying consent decree);
5         (3) prohibitions on abortion counseling and referral
6     by recipients of State funds (410 ILCS 230/4-100) and 77
7     Ill. Admin. Code 655.10;
8         (4) limitations on use of State funds to purchase
9     insurance coverage for abortions (5 ILCS 375/6.1);
10         (5) requiring only a licensed physician to perform an
11     abortion (720 ILCS 510/3.1);
12         (6) Health Care Right of Conscience Act (745 ILCS
13     70/Act); and
14         (7) abortion reporting (77 Ill. Adm. Code 505.20
15     through 505.50); and
 
16     WHEREAS, The federal "Freedom of Choice Act" will not make
17 abortion safe or rare, but will instead actively promote and
18 subsidize abortion with state and federal tax dollars and do
19 nothing to ensure its safety; and
 
20     WHEREAS, The federal "Freedom of Choice Act" will protect
21 and promote the abortion industry, sacrifice women and their
22 health to a radical political ideology of unregulated abortion-
23 on-demand, and silence the voices of everyday Americans who
24 want to engage in a meaningful public discussion and debate

1 over the availability, safety, and even desirability of
2 abortion; therefore, be it
 
3     RESOLVED, BY THE SENATE OF THE NINETY-SIXTH GENERAL
4 ASSEMBLY OF THE STATE OF ILLINOIS, that the Senate strongly
5 opposes the federal "Freedom of Choice Act" and urges the
6 United States Congress to summarily reject it; and be it
7 further
 
8     RESOLVED, That the Senate strongly opposes the federal
9 "Freedom of Choice Act" because it seeks to circumvent the
10 states' general legislative authority as guaranteed by the 10th
11 Amendment to the United States Constitution; and be it further
 
12     RESOLVED, That the Senate strongly opposes the federal
13 "Freedom of Choice Act" because it seeks to undermine the right
14 and responsibility of the states and the people to debate, vote
15 on, and determine abortion policy; and be it further
 
16     RESOLVED, That the Senate strongly opposes the federal
17 "Freedom of Choice Act" because the protection of women's
18 health through state regulations on abortion is a compelling
19 state interest that should not be nullified by Congress; and be
20 it further
 
21     RESOLVED, That the Senate strongly opposes the federal

1 "Freedom of Choice Act" because its enactment would nullify 7
2 laws in the state of Illinois, laws that the legislature and
3 the people of Illinois strongly support; and be it further
 
4     RESOLVED, That suitable copies of this resolution be
5 transmitted to the Governor, the President of the United
6 States, the President and President pro tempore of the Senate,
7 and the U.S. Speaker of the House of Representatives, and each
8 member of the Illinois Congressional Delegation.
