AMENDMENT TO HOUSE BILL 1084

2    AMENDMENT NO. ______. Amend House Bill 1084 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Governor's Office of Management and Budget
5Act is amended by changing Section 2 as follows:
 
6    (20 ILCS 3005/2)  (from Ch. 127, par. 412)
7    Sec. 2. There is created in the executive office of the
8Governor an Office to be known as the Governor's Office of
9Management and Budget. The Office shall be headed by a
10Director, who shall be appointed by the Governor, by and with
11the advice and consent of the Senate. The term of office of the
12Director shall expire on the third Monday of January in odd
13numbered years provided that he or she shall hold office until
14a successor is appointed and qualified.
15    Any vacancy in the office of the Director shall be filled
16pursuant to the provisions of this amendatory Act of the 97th

1General Assembly. In case of a vacancy during the recess of the
2Senate, the Governor shall make a temporary appointment until
3the next meeting of the Senate, when the Governor shall
4nominate a person to fill the office, and any person so
5nominated who is confirmed by the Senate shall hold office
6during the remainder of the term and until his or her successor
7is appointed and qualified.
8    No person shall perform the duties and functions of the
9Director, or otherwise exercise the authority of the Director,
10unless he or she has been appointed by the Governor pursuant to
11this Section. The functions of the Office shall be as
12prescribed in Sections 2.1 through 2.7 of this Act.
13    On the effective date of this amendatory Act of the 97th
14General Assembly, the office of Director shall be considered
15vacant and thereafter shall be filled only pursuant to the
16provisions of this amendatory Act of the 97th General Assembly.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
