2 | AMENDMENT NO. ______. Amend House Bill 1228, by replacing | ||||||
3 | everything after the enacting clause, as follows:
| ||||||
4 | "Section 5. The Illinois Plumbing License Law is amended by | ||||||
5 | changing Sections 13.1, 16, and 42 as follows:
| ||||||
6 | (225 ILCS 320/13.1)
| ||||||
7 | Sec. 13.1. Plumbing contractors; registration; | ||||||
8 | applications.
| ||||||
9 | (1) On and after May 1, 2002, all persons or corporations | ||||||
10 | desiring to
engage in
the
business of plumbing contractor, | ||||||
11 | other than any entity that maintains an
audited net worth of | ||||||
12 | shareholders' equity equal to or exceeding $100,000,000,
shall
| ||||||
13 | register in accordance with the
provisions of this
Act.
| ||||||
14 | (2) Application for registration shall be filed with the | ||||||
15 | Department each
year, on
or before the last day of
September, | ||||||
16 | in writing and on forms
prepared and
furnished by the |
| |||||||
| |||||||
1 | Department. All plumbing contractor registrations expire
on | ||||||
2 | the last
day of
September of each year.
| ||||||
3 | (3) Applications shall contain the name, address, and | ||||||
4 | telephone number of
the
person and the plumbing license of (i) | ||||||
5 | the individual, if a sole
proprietorship; (ii) the
partner, if | ||||||
6 | a partnership; or (iii) an officer, if a corporation. The
| ||||||
7 | application shall contain
the business name, address, and | ||||||
8 | telephone number, a current copy of the
plumbing
license, and | ||||||
9 | any other information the Department may require by rule.
| ||||||
10 | (4) Applicants shall submit an original certificate of | ||||||
11 | insurance
documenting that
the contractor carries general | ||||||
12 | liability insurance with a minimum of $100,000
per
occurrence, | ||||||
13 | a minimum of $300,000 aggregate
for bodily injury,
property | ||||||
14 | damage insurance with a minimum of $50,000 or a minimum of | ||||||
15 | $300,000
combined single limit, and workers compensation
| ||||||
16 | insurance with a minimum $500,000 employer's liability. No | ||||||
17 | registration
may be issued in the
absence of this
certificate. | ||||||
18 | Certificates must be in force at all times for registration to
| ||||||
19 | remain valid.
| ||||||
20 | (5) Applicants shall submit, on a form provided by the | ||||||
21 | Department, an
indemnification bond in the amount of $20,000 or | ||||||
22 | a letter of credit in the same
amount
for work performed in | ||||||
23 | accordance with this Act and the rules promulgated under
this | ||||||
24 | Act.

25 | (6) All employees of a registered
plumbing
contractor who | ||||||
26 | engage in plumbing work shall be licensed plumbers or |
| |||||||
| |||||||
1 | apprentice
plumbers in accordance with this Act.
| ||||||
2 | (7) Plumbing contractors shall submit an annual | ||||||
3 | registration fee in an
amount to
be established by rule.
| ||||||
4 | (8) The Department shall be notified in advance of any | ||||||
5 | changes in the
business
structure, name, or location or of the | ||||||
6 | addition or deletion of the owner or
officer who is the
| ||||||
7 | licensed plumber listed on the application. Failure to notify | ||||||
8 | the Department
of this
information is grounds for suspension or | ||||||
9 | revocation of the plumbing
contractor's
registration.
| ||||||
10 | (9) In the event that the plumber's license on the | ||||||
11 | application for
registration of a
plumbing contractor is a | ||||||
12 | license issued by the City of Chicago, it shall be the
| ||||||
13 | responsibility of the
applicant to forward a copy of the | ||||||
14 | plumber's license to the Department, noting
the name of the
| ||||||
15 | registered
plumbing contractor, when it is renewed. In the | ||||||
16 | event that the plumbing contractor's registration is suspended | ||||||
17 | or revoked, the Department shall notify the City of Chicago and | ||||||
18 | any corresponding plumbing contractor's license issued by the | ||||||
19 | City of Chicago shall be suspended or revoked.

23 | Sec. 16.
(1) Any city, village or incorporated town, having | ||||||
24 | a population of
500,000 or more may, by an ordinance containing | ||||||
25 | provisions substantially
the same as those in this Act and |

1 | specifying educational or experience
requirements equivalent | ||||||
2 | to those prescribed in this Act, provide for a
board of | ||||||
3 | plumbing examiners to conduct examinations for, and to issue,
| ||||||
4 | suspend, or revoke, plumbers' licenses, within such city, | ||||||
5 | village or
incorporated town. Upon the enactment of such | ||||||
6 | ordinance the provisions of
this act shall not apply within any | ||||||
7 | such municipality except as otherwise
provided herein.
| ||||||
8 | (2) Any person licensed as a plumber pursuant to such | ||||||
9 | ordinance, or
licensed by the Department under this Act, may | ||||||
10 | engage in plumbing anywhere
in this State.
| ||||||
11 | (3) Any board of plumbing examiners created pursuant to | ||||||
12 | this Section
shall maintain a current record similar to that | ||||||
13 | required of the Director by
Section 8 of this Act, and shall | ||||||
14 | provide the Department with a copy
thereof. The Department | ||||||
15 | shall be advised of changes in such record at least
every six | ||||||
16 | months.

17 | (4) In the event that the plumbing contractor's license is | ||||||
18 | suspended or revoked by any city, village, or incorporated | ||||||
19 | town, having a population of 500,000 or more, the city, | ||||||
20 | village, or incorporated town shall notify the Department. | ||||||

23 | Sec. 42. Home rule. Pursuant to paragraph (h) of Section 6 | ||||||

VII
of the Illinois Constitution of 1970 the power | ||||||
25 | to regulate the licensing of
plumbers, to adopt the |

1 | promulgation of a minimum plumbing code of
standards,
and the | ||||||
2 | power to regulate the registration of irrigation contractors | ||||||
3 | and plumbing contractors shall,
except as may otherwise be | ||||||
4 | provided within and pursuant to the provisions of
Section 16 | ||||||
5 | and Section 16.1 of this Act, be exercised by the State and may
| ||||||
6 | not be exercised by
any unit of local government, including | ||||||
7 | home rule units.
