SYNOPSIS AS INTRODUCED:
 
30 ILCS 120/14  from Ch. 85, par. 664

    Amends the Agricultural Fair Act. Provides that the extension leader of each county or unit shall certify to the State 4-H Officer the projected amount to be paid out in premiums per exhibitor for the current fair season. Provides that the certification shall be based upon the certified number of eligible 4-H members from the previous 4-H year. Provides that, upon receipt of the certification, the Department of Agriculture shall make payment to the officer or organization. Provides that all extension publications stating the cash premiums will be awarded shall recite that awards are subject to modifications or cancellation in any year for which the General Assembly fails to make an appropriation to fund the premiums. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Agricultural Fair Act is amended by changing
5Section 14 as follows:
 
6    (30 ILCS 120/14)  (from Ch. 85, par. 664)
7    Sec. 14. 4-H.
8    (a) University of Illinois extension units that conduct at
9least one show or exhibition of the eligible members' project
10work approved by the State 4-H Office and that pay premium
11moneys promptly in cash, including $800 maximum in judges'
12fees, shall be eligible to participate in an appropriation made
13for this purpose by the General Assembly. As directed by the
14University, each county's extension leader shall report to the
15State 4-H Office the eligible number of members participating
16in the 4-H year. The University shall then file with the Bureau
17of County Fairs and Horse Racing an Accountability for
18Agricultural Premiums report certifying the number of eligible
194-H members. All appropriated moneys are to be fully expended
20as specified (see Part 260 Fairs Operating Under the
21Agricultural Fair Act Sec. 260.305). If moneys are not fully
22expended, they shall be returned to the Illinois Department of
23Agriculture, Bureau of County Fairs and Horse Racing. The

1provisions of this Section shall not apply to more than one
2show or exhibition per calendar year of any one class or type
3of project work. Based on each year's specified appropriation
4and as determined by the Department, the county or extension
5unit shall participate at a rate predetermined by the Bureau
6per eligible member for the year as recorded in the State 4-H
7Office.
8    (b) Premium payments. The extension leader of each county
9or unit shall certify to the State 4-H Officer under oath on a
10form furnished by the Department the projected amount to be
11paid out in premiums per exhibitor at the show or exhibition
12for the current fair season and the name of the officer or
13organization making those projections. The certification shall
14be based upon the certified number of eligible 4-H members from
15the previous 4-H year, reported to the Department as of
16December 31 of that year. Upon receipt of the certification the
17Department shall make payment to the officer or organization in
18accordance with the provisions of this Section.
19    (c) Reimbursement for judges' fees and ribbons. The
20extension leader of each county or unit shall certify to the
21State 4-H Officer under oath on a form furnished by the
22Department the amount paid out in premiums, judges' fees, and
23ribbons at the show or exhibition for the current fair season
24year and the name of the officer or organization making the
25payments and the number of eligible members for the current
26year. This certification shall be accompanied by itemized

1receipts as evidence of the certified amounts, and it must be
2filed with the Department before December 31 of each year. Upon
3receipt of the certification the Department shall reimburse the
4officer or organization making the payments in accordance with
5the provisions of this Section.
6    (d) Subject to continued appropriation and availability of
7cash. All extension publications stating that cash premiums
8will be awarded shall recite that awards are subject to
9modification or cancellation in any year for which the General
10Assembly fails to make an appropriation to fund the premiums.

12    Section 99. Effective date. This Act takes effect upon
13becoming law.
