SYNOPSIS AS INTRODUCED:
 
765 ILCS 130/10.1  from Ch. 54, par. 10.1

    Amends the Fence Act. Provides that if the fence viewers fail to decide within 60 (instead of 90) days after the matter was submitted to them, either the county board or the township board of trustees may assume jurisdiction of the matter and make a decision. If neither the county board nor the township board of trustees makes a decision thereon within 60 days after the expiration of such 60 (instead of 90)day period, either party may petition the circuit court to decide the matter.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fence Act is amended by changing Section
510.1 as follows:
 
6    (765 ILCS 130/10.1)  (from Ch. 54, par. 10.1)
7    Sec. 10.1. If for any reason the fence viewers shall fail
8to make a decision within 60 90 days after the matter has been
9submitted to them, either the county board or the township
10board of trustees may assume jurisdiction of the matter and
11make a decision thereon. If neither the county board nor the
12township board of trustees makes a decision thereon within 60
13days after the expiration of such 60 90 day period, either
14party may petition the circuit court of the county in which the
15fence is located to make the decision thereon and in such case
16the circuit court shall have original jurisdiction to hear and
17decide the matter.
