SYNOPSIS AS INTRODUCED:

720 ILCS 5/24.7-5 new

    Amends the Criminal Code of 1961. Provides that it is a Class A misdemeanor to sell etching acid to another person under 18 years of age. Defines "etching acid". Provides that any person, before selling etching acid to a prospective purchaser, must demand and be shown by the prospective purchaser adequate written evidence of the age and identity of the purchaser issued by a federal, state, county, or municipal government, or a subdivision or agency of that government. Provides that a person who knowingly uses etching acid to damage, deface, deform, or destroy the property of another person without the consent of the owner of that property is guilty of a Class A misdemeanor.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 1961 is amended by adding
5Article 24.7 as follows:
 
6    (720 ILCS 5/Art. 24.7 heading new)

ARTICLE 24.7. ETCHING ACID

 
8    (720 ILCS 5/24.7-5 new)
9    Sec. 24.7-5. Etching acid.
10    (a) For the purposes of this Section, "etching acid" means
11any liquid, cream, paste, or similar chemical substance that
12can be used to etch, draw, carve, sketch, engrave, or otherwise
13alter, change, or impair the physical integrity of glass or
14metal.
15    (b) A person shall not sell etching acid to another person
16under 18 years of age.
17    (c) The seller of etching acid, before selling etching acid
18to a prospective purchaser, shall demand adequate written
19evidence of identity of the prospective purchaser and of the
20fact that he or she is over the age of 18 years. Adequate
21written evidence of age and identity of the prospective
22purchaser is a document issued by a federal, state, county, or

1municipal government, or a subdivision or agency of that
2government, including, but not limited to, a motor vehicle
3operator's license, a state identification card, a
4registration certificate issued under the Federal Selective
5Service Act, or an identification card issued to a member of
6the Armed Forces.
7    (d) Sentence.
8        (1) A seller of etching acid who violates this Section
9    is guilty of a Class A misdemeanor.
10        (2) A person who knowingly uses etching acid to damage,
11    deface, deform, or destroy the property of another person
12    without the consent of the owner of that property is guilty
13    of a Class A misdemeanor.
