1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Highway Code is amended by adding | ||||||
5 | Section 6-111.5 as follows: | ||||||
6 | (605 ILCS 5/6-111.5 new) | ||||||
7 | Sec. 6-111.5. Elimination of county unit road districts. A | ||||||
8 | county unit road district may be eliminated by referendum. The | ||||||
9 | process, petition, and referendum requirements shall be | ||||||
10 | identical to those requirements used to form a county unit road | ||||||
11 | district under Section 6-111 of this Code, except that the | ||||||
12 | referendum question shall be "Shall the county unit road | ||||||
13 | district in .... County, Illinois be eliminated and road | ||||||
14 | districts be created in its place?". | ||||||
15 | (a) If a majority of voters at any general election votes | ||||||
16 | to eliminate a county unit road district, the county board of | ||||||
17 | the county shall determine what road districts to adopt in | ||||||
18 | place of the eliminated county unit road district. The county | ||||||
19 | board shall form a committee of no more than 9 persons to study | ||||||
20 | and recommend to the board what type of road districts and what | ||||||
21 | geographic boundaries should be put into place. The committee | ||||||
22 | should consider mileage of roads, tax base, population, and | ||||||
23 | natural and manmade geographic limitations in recommending the |

1 | geographic boundaries. The corporate limits of any | ||||||
2 | municipality within the county may be its own geographic unit | ||||||
3 | for the proposed new road districts. The committee shall also | ||||||
4 | recommend the distribution of county unit road district assets | ||||||
5 | and resources. | ||||||
6 | (b) The committee may prepare more than one proposal, but | ||||||
7 | not more than 3 proposals, to present to the board for a final | ||||||
8 | decision. The committee shall be formed, a budget set, and a | ||||||
9 | chairperson determined by the board within 60 days of the | ||||||
10 | election to eliminate the county unit road district. The | ||||||
11 | committee shall present the proposal or proposals to the board | ||||||
12 | within 150 days of the election. | ||||||
13 | (c) The board shall hold public hearings as it determines | ||||||
14 | is necessary for public review and comment on the proposal or | ||||||
15 | proposals of the committee within 60 days of receiving the | ||||||
16 | proposal or proposals from the committee. Within 30 days after | ||||||
17 | the public hearing or hearings, the board may return the | ||||||
18 | proposal or any number of the proposals to the committee for a | ||||||
19 | review and consideration of amendments based upon the comments | ||||||
20 | from the public hearing or hearings. If the board returns the | ||||||
21 | proposal to the committee for review and possible amendment, | ||||||
22 | the committee has 30 days to complete its review, make any | ||||||
23 | amendments, and return the final proposal or proposals to the | ||||||
24 | board. | ||||||
25 | (d) No more than 30 days from the date of the last public | ||||||
26 | hearing, or from the receipt of the final proposal or proposals |

1 | from the committee if the board sent the proposal or proposals | ||||||
2 | back to the committee for review and consideration of | ||||||
3 | amendment, the board shall make a final determination as to | ||||||
4 | what form of road districts shall replace the county unit road | ||||||
5 | district. | ||||||
6 | (e) The board shall determine and oversee all steps | ||||||
7 | required to divide the resources and assets of the road | ||||||
8 | districts that replaces the county unit road district. The | ||||||
9 | county unit road district shall be eliminated and the new road | ||||||
10 | districts shall be created simultaneously on a date set by the | ||||||
11 | board, no later than 365 days from the date of the election to | ||||||
12 | eliminate the county unit road district. The board shall | ||||||
13 | designate the title of and appoint the head or heads of the | ||||||
14 | various divisions of the new road districts. The positions | ||||||
15 | shall be voted on at the next general election after the | ||||||
16 | election to eliminate the county unit road district and every 4 | ||||||
17 | years thereafter. If the board adopts a road district system | ||||||
18 | where municipalities are a geographic boundary, the | ||||||
19 | commissioner in charge of the roads within a municipality shall | ||||||
20 | automatically be the supervisor based upon the election process | ||||||
21 | and terms for each municipality.

22 | Section 99. Effective date. This Act takes effect July 1, | ||||||
23 | 2011.
