SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.786 new
30 ILCS 105/6z-87 new
35 ILCS 5/507YY new

    Amends the State Finance Act. Creates the Veterans' Prosthesis Fund as a special fund in the State treasury. Provides that moneys in the Fund shall be used by the Department of Veterans' Affairs for the purpose of making grants to Illinois veterans to update and replace the veteran's existing prosthesis. Amends the Illinois Income Tax Act to create a tax checkoff for the Veterans' Prosthesis Fund. Effective immediately.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Sections 5.786 and 6z-87 as follows:
 
6    (30 ILCS 105/5.786 new)
7    Sec. 5.786. The Veterans' Prosthesis Fund.

9    Sec. 6z-87. The Veterans' Prosthesis Fund; creation. The
10Veterans' Prosthesis Fund is created as a special fund in the
11State treasury. Moneys in the Fund shall be used by the
12Department of Veterans' Affairs for the purpose of making
13grants to Illinois veterans to update and replace the veteran's
14existing prosthesis. The Department shall adopt rules
15concerning eligibility for the grants. The Fund may receive
16moneys from the veterans' prosthesis income tax checkoff
17created in Section 507YY of the Illinois Income Tax Act, as
18well as public and private donations. All federal funds made
19available to the State for the purpose of aiding veterans in
20updating or replacing prostheses shall be deposited into the
21Veterans' Prosthesis Fund.

1    Section 10. The Illinois Income Tax Act is amended by
2adding Section 507YY as follows:
 
3    (35 ILCS 5/507YY new)
4    Sec. 507YY. Veterans' prosthesis checkoff. For taxable
5years ending on or after December 31, 2011, the Department
6shall print, on its standard individual income tax form, a
7provision indicating that, if the taxpayer wishes to contribute
8to the Veterans' Prosthesis Fund, as authorized by this
9amendatory Act of the 97th General Assembly, then he or she may
10do so by stating the amount of the contribution (not less than
11$1) on the return and indicating that the contribution will
12reduce the taxpayer's refund or increase the amount of payment
13to accompany the return. The taxpayer's failure to remit any
14amount of the increased payment reduces the contribution
15accordingly. This Section does not apply to any amended return.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.
