1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Illinois Main Street Act.
 
6    Section 5. Legislative purpose. The General Assembly makes
7the following findings:
8        (1) The continued economic vitality of downtown and
9    neighborhood commercial districts in our municipalities is
10    essential to community preservation, social cohesion, and
11    economic growth.
12        (2) Municipalities need to maintain their local
13    economies so that business owners will be able to provide
14    goods and services to the community, to provide employment
15    opportunities, to avoid disinvestment and economic
16    dislocations, and to develop and sustain downtown and
17    neighborhood commercial district revitalization programs
18    to address these problems.
 
19    Section 10. Definitions. As used in this Act:
20    "Department" means the Department of Commerce and Economic
21Opportunity.
22    "Director" means the Director of Commerce and Economic

1Opportunity.
2    "Program" means the Illinois Main Street Program.
 
3    Section 15. Illinois Main Street Program. The Illinois Main
4Street Program is created within the Department. In order to
5implement the Illinois Main Street Program, the Department
6shall do all of the following:
7        (1) Provide assistance to municipalities designated as
8    Main Street Communities, municipalities interested in
9    becoming designated through the program, and businesses,
10    property owners, organizations, and municipalities
11    undertaking a comprehensive downtown or neighborhood
12    commercial district revitalization initiative and
13    management strategy. Assistance may include, but is not
14    limited to, initial site evaluations and assessments,
15    training for local programs, training for local program
16    staff, site visits and assessments by technical
17    specialists, local program design assistance and
18    evaluation, and continued local program on-site
19    assistance.
20        (2) To the extent funds are made available, provide
21    financial assistance to municipalities or local
22    organizations to assist in initial downtown or
23    neighborhood commercial district revitalization program
24    specialized training, specific project feasibility
25    studies, market studies, and design assistance.

1        (3) Operate the Illinois Main Street Program in
2    accordance with the plan developed by the Department.
3        (4) Consider other factors the Department deems
4    necessary for the implementation of this Act.
 
5    Section 20. Main Street Community designation.
6    (a) The Department shall adopt criteria for the designation
7of a Main Street Community. In establishing the criteria, the
8Department shall consider all of the following:
9        (1) The degree of interest and commitment to
10    comprehensive downtown or neighborhood commercial district
11    revitalization and, where applicable, historic
12    preservation by both the public and private sectors.
13        (2) The evidence of potential private sector
14    investment in the downtown or neighborhood commercial
15    district.
16        (3) Where applicable, a downtown or neighborhood
17    commercial district with sufficient historic fabric to
18    become a foundation for an enhanced community image.
19        (4) The capacity of the organization to undertake a
20    comprehensive program and the financial commitment to
21    implement a long-term downtown or neighborhood commercial
22    district revitalization program that includes a commitment
23    to employ a professional program manager.
24        (5) The National Main Street Center's criteria for
25    designating official main street municipalities.

1        (6) Other factors the Department deems necessary for
2    the designation of a local program.
3    (b) Illinois Main Street shall designate local downtown or
4neighborhood commercial district revitalization programs and
5official local main street programs.
6    (c) The Department must approve all local downtown or
7neighborhood commercial district revitalization program
8boundaries. The boundaries of a local downtown or neighborhood
9commercial district revitalization program are typically
10defined using the pedestrian core of a traditional commercial
11district.
 
12    Section 25. Illinois Main Street Plan. The Department
13shall, in consultation with the Lieutenant Governor, develop a
14plan for the Illinois Main Street Program. The plan shall
15describe:
16        (1) the objectives and strategies of the Illinois Main
17    Street Program;
18        (2) how the Illinois Main Street Program will be
19    coordinated with existing federal, state, local, and
20    private sector business development and historic
21    preservation efforts;
22        (3) the means by which private investment will be
23    solicited and employed;
24        (4) the methods of selecting and providing assistance
25    to participating local programs; and

1        (5) a means to solicit private contributions for State
2    and local operations of the Illinois Main Street Program.
 
3    Section 30. Role of the Lieutenant Governor. The Lieutenant
4Governor shall be the Ambassador of the Illinois Main Street
5Program. The Department shall advise and consult with the
6Lieutenant Governor on the activities of the Illinois Main
7Street Program. The Lieutenant Governor, with the assistance of
8the Department, shall promote and encourage the success of the
9Illinois Main Street Program.
 
10    Section 35. Illinois Main Street Fund. The Illinois Main
11Street Fund is created as a special fund in the State treasury.
12All receipts from private contributions, federal funds,
13legislative appropriations, and fees for services, if levied,
14must be deposited into the Fund. Subject to appropriation,
15expenditures from the Fund may be used only for the benefit of
16the Illinois Main Street Program.
 
17    Section 90. The Green Governments Illinois Act is amended
18by changing Sections 15, 35, and 45 as follows:

20    Sec. 15. Composition of the Council. The Council shall be
21composed comprised of representatives from various State

1procurement, educational, and environmental policy expertise.
2Until the effective date of this amendatory Act of the 97th
3General Assembly, the The Lieutenant Governor is the chair of
4the Council. On and after the effective date of this amendatory
5Act of the 97th General Assembly, the Governor is the chair of
6the Council, and the Lieutenant Governor, or his or her
7designee, shall be a member of the council. The director or
8President, respectively, of each of the following State
9agencies and State universities, or his or her designee, is a
10member of the Council: the Department of Commerce and Economic
11Opportunity, the Environmental Protection Agency, the
12University of Illinois, the Department of Natural Resources,
13the Department of Central Management Services, the Governor's
14Office of Management and Budget, the Department of Agriculture,
15the Department of Transportation, the Department of
16Corrections, the Department of Human Services, the Department
17of Public Health, the State Board of Education, the Board of
18Higher Education, and the Capital Development Board. The Office
19of the Lieutenant Governor shall provide administrative
20support to the Council. A minimum of one staff position in the
21Office of the Lieutenant Governor shall be dedicated to the
22Green Governments Illinois program.

1    Sec. 35. Environmental Plans and Reporting.
2    (a) Each State agency shall submit an annual adopted
3environmental sustainability plan to the chairman of the
4Council for review and approval on or before April 1, 2008 and
5each April 1 thereafter.
6    On or before November 1, 2007, the Council shall prepare a
7downloadable plan template designed to provide a simple
8framework for the development of an environmental
9sustainability plan as required by this Act. The Council shall
10adopt procedures for reviewing and approving the plans, and
11make staff available during preparation of the plans to assist
12State agencies with their plan-writing efforts. The Council
13shall complete its plan review process on or before June 1,
142008. The sustainability plans shall be reviewed and updated
15periodically, but at least once every 3 years. Units of local
16government and educational institutions are encouraged to
17submit similar sustainability plans to the chairman of the
18Council for review and approval.
19    (b) On or before January 1, 2008, each State agency, using
20existing resources, shall form an internal environmental
21sustainability committee. The environmental sustainability
22committee shall (i) assess the environmental and resource use
23impacts of its major operational activities making
24environmental improvements, conserving resources, and reducing
25health risks; (ii) develop an annual environmental
26sustainability plan as required under this Act; and (iii)

1establish an ongoing process through which their
2sustainability efforts can be reviewed and improved upon. The
3committee shall focus on the most significant environmental and
4resource use impacts, examine the feasibility and
5cost-effectiveness of addressing these impacts, and prioritize
6their actions accordingly.
7    Where feasible, the committee shall quantify the specific
8impacts of major operational activities such as gallons of
9water used, pounds of solid waste generated, gallons of
10gasoline consumed, and dollars spent per year on electricity.
11The committee shall consist of representatives from different
12departments and program areas, including purchasing,
13maintenance, and facility management. A senior member of
14management shall be designated to coordinate environmental
15sustainability efforts of each committee. The coordinator
16shall provide information to agency facilities and staff,
17coordinate planning and reporting activities, and act as
18liaison to the Council. Where appropriate, State agencies may
19appoint facility coordinators in addition to the agency
20coordinator. Coordinators shall be given full management
21support and provided with the necessary resources to meet the
22goals of this Act.
23    (c) On or before July 1, 2008 and on or before September 1
24of each subsequent year, each State agency shall submit to the
25chairman of the Council a report summarizing the progress made
26in implementing its annual environmental sustainability plan,

1including sustainability measures adopted and goals achieved.
2The information in this report shall encompass the previous
3fiscal year.
4    On or before June 1, 2008, the Council shall develop and
5adopt a reporting form to be used to comply with the provisions
6of this Section. Participating units of local government and
7educational institutions are encouraged to submit an annual
8progress report on or before September 1 of each year.
9    (d) State agencies shall be invited to participate in the
10Council's efforts to foster environmental sustainability
11practices throughout State government.
12    (e) The Council shall provide technical assistance to State
13agencies, units of local government, and educational
14institutions for the purpose of implementing the environmental
15sustainability planning requirement.
16    (f) The Council may establish criteria for exempting select
17State agencies from the environmental sustainability planning
18based on staff size, probable environmental impacts, and scope
19of operations.

23    (a) The Green Governments Illinois staff member of the
24Lieutenant Governor's Office shall be responsible for
25establishing and maintaining an Internet website devoted to the

1Green Governments Illinois program.
2    (b) The content and capabilities of the website shall, at a
3minimum, include:
4        (1) (blank) the ability to receive submitted plans and
5    reports;
6        (2) (blank) a downloadable template for preparing
7    reports;
8        (3) viewable and downloadable plans and reports
9    submitted by the participating units of State and local
10    government and educational institutions;
11        (4) a listing of sources of information on developing
12    environmental programs and Internet links, if available,
13    to those sources;
14        (5) a listing of sources of funding for environmental
15    programs and Internet links, if available, to those
16    sources;
17        (6) information on forming intergovernmental
18    agreements for the purpose of developing collaborative
19    environmental plans between units of local government; and
20        (7) guidance materials to assist State agencies, units
21    of local government, and educational institutions in
22    identifying environmental impacts and evaluating practical
23    actions to prevent pollution and conserve resources.
