SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/18c-7405

    Amends the Illinois Vehicle Code. Provides that a Section concerning accident counseling shall apply to Class I and Class II (instead of only Class I) rail carriers. Provides that each Class I and Class II rail carrier must review and update its accident counseling or trauma program filing on an annual basis. Provides that programs may be filed either by mail or electronically via an email address designated by the Illinois Commerce Commission. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 18c-7405 as follows:
 
6    (625 ILCS 5/18c-7405)
7    Sec. 18c-7405. Accident counseling.
8    (a) Every Class I and Class II rail carrier, according to
9federal regulations, operating in this State must establish a
10counseling or trauma program and provide or make available
11counseling or other critical incident stress debriefing
12services to each member of an operating crew directly involved
13in an accident that results in loss of life or serious bodily
14injury on its railway or right-of-way.
15    (b) Each Class I and Class II rail carrier, according to
16federal regulations, operating in this State must file its
17counseling or trauma program with the processing section of the
18Transportation Division of the Illinois Commerce Commission,
19whose sole responsibility under this Section shall be to
20receive the program and make it available for public
21inspection. Each rail carrier subject to this subsection (b)
22must review and update its counseling or trauma program filing
23on an annual basis. Programs may be filed by mail or electronic

1mail. Electronic filings shall be submitted to an email address
2designated by the Commission.
