AMENDMENT TO HOUSE BILL 4434

2    AMENDMENT NO. ______. Amend House Bill 4434 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Prevailing Wage Act is amended by changing
5Section 3 as follows:
 
6    (820 ILCS 130/3)  (from Ch. 48, par. 39s-3)
7    Sec. 3. Not less than the general prevailing rate of hourly
8wages for work of a similar character on public works in the
9locality in which the work is performed, and not less than the
10general prevailing rate of hourly wages for legal holiday and
11overtime work, shall be paid to all laborers, workers and
12mechanics employed by or on behalf of any public body engaged
13in the construction or demolition of public works. This
14includes any maintenance, repair, assembly, or disassembly
15work performed on equipment whether owned, leased, or rented.
16Only such laborers, workers and mechanics as are directly

1employed by contractors or subcontractors in actual
2construction work on the site of the public work and laborers,
3workers, and mechanics employed by contractors and
4subcontractors engaged in construction work at one or more
5other locations that are necessary in the execution of the
6contract or subcontract of construction of the public work
7including, but not limited to, building or construction job,
8and laborers, workers, and mechanics engaged in the
9transportation of materials and equipment to or from the site
10or between sites, but not including the transportation by the
11sellers and suppliers or the manufacture or processing of
12materials or equipment, in the execution of any contract or
13contracts for public works with any public body shall be deemed
14to be employed upon public works. The wage for a tradesman
15performing maintenance is equivalent to that of a tradesman
16engaged in construction or demolition.
