AMENDMENT TO HOUSE BILL 4569

2    AMENDMENT NO. ______. Amend House Bill 4569 as follows:
 
3on page 1, line 5, by replacing "Sections 6a, 8a, 8c, 9, and
410b.16" with "Sections 5c, 8a, and 8c"; and
 
5on page 1, immediately below line 6, by inserting the
6following:
 
7    "(15 ILCS 310/5c)  (from Ch. 124, par. 105c)
8    Sec. 5c. Partial exemptions. The following positions in the
9Office of the Secretary of State are exempt from jurisdictions
10A, B and C to the extent stated for each unless these
11jurisdictions are extended as provided in this Act:
12    (1) Special agents selected by the Inspector General
13appointed pursuant to Section 14 of the Secretary of State Act
14and licensed Licensed attorneys in positions as legal or
15technical advisors, except in those positions paid from federal

1funds if such exemption is inconsistent with federal
2requirements, are exempt from jurisdiction B only to the extent
3that Sections 10b.1, 10b.3 and 10b.5 of this Code need not be
4met.
5    (2) All unskilled positions, unless such exemption is
6inconsistent with federal requirements in those positions paid
7from federal funds, for which the principal job requirement is
8good physical condition are exempt from jurisdiction B.
9    (3) The Merit Commission, upon written recommendation of
10the Director, shall exempt from jurisdiction B other positions
11which, in the judgment of the Commission, are by their nature
12highly confidential or involve principal administrative
13responsibility for the determination of policy or principal
14administrative responsibility for the way in which policies are
15carried out, except in those positions paid from federal funds
16if such exemption is inconsistent with federal requirements. No
17position which has the powers of a law enforcement officer,
18except executive security officers, may be exempted under this
19section.
20    (4) The personal secretaries and chief deputy to persons
21exempted under paragraph (3) of Section 5b of this Act are
22exempt from jurisdiction B, unless such exemption is
23inconsistent with federal requirements in those positions paid
24from federal funds.
25    (5) Positions which are paid a prevailing rate of wage are
26exempt from jurisdiction B.
