AMENDMENT TO HOUSE BILL 4857

2    AMENDMENT NO. ______. Amend House Bill 4857 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Sections 6-701.1, 6-701.2, and 9-130 as follows:
 
6    (605 ILCS 5/6-701.1)  (from Ch. 121, par. 6-701.1)
7    Sec. 6-701.1.
8    (a) The construction of any township or district road
9located within the road district.
10    (b) The construction of grade separations and approaches
11thereto which avoid or replace grade crossings at intersections
12of township or district roads and railroad tracks.
13    The highway commissioners of the several road districts, in
14cooperation with the county superintendent of highways of their
15respective counties, shall select the roads and grade
16separations to be constructed with motor fuel tax funds. In the

1selection of roads, preference shall be given to public school
2bus routes and rural free delivery mail routes. The county
3superintendent of highways, in cooperation with the respective
4highway commissioners, shall prepare, or cause to be prepared
5maps showing the roads and grade separations selected and shall
6prepare the necessary plans, specifications and estimates of
7cost of such construction, all of which shall be submitted to
8the Department for approval. The type of construction selected
9shall be adequate for present or reasonably anticipated traffic
10needs as determined by the county superintendent of highways
11and the respective highway commissioners and approved by the
12Department.
13    The construction work provided for in this Section may be
14done by contract or day labor with county or road district
15equipment and forces as the county superintendent of highways
16and the respective highway commissioners may determine.
17Contracts for construction work shall be advertised for and let
18by the county board in county unit road districts and by the
19highway commissioner in township road districts. Contracts
20shall be let to the lowest responsible bidder subject to the
21approval of the county superintendent of highways or the
22highway commissioner and such contracts also shall be subject
23to approval by the Department. The construction work shall be
24carried on under the immediate supervision of the highway
25commissioner and under the general supervision of the county
26superintendent of highways and all work upon such projects

1shall be subject to approval by the Department.
2    In any county in which a county unit road district has been
3created the county superintendent of highways for such county
4shall perform all of the functions of a highway commissioner
5under this Section with respect to the district roads in such
6county.

9    Sec. 6-701.2.
10    Maintenance of any township or district road as defined in
11Section 2-103 or any grade separation constructed as provided
12in Section 6-701.1, subject to the approval of the county
13superintendent of highways and the Department.
14    Maintenance work provided for in this Section may be done
15by contract or with county or road district equipment or forces
16as the county superintendent of highways and the respective
17highway commissioners may determine. If any road or grade
18separation constructed in any road district as provided in this
19Section is not maintained in a manner satisfactory to the
20Department and the county, no further funds shall be expended
21in such road district until such road or grade separation is so
22maintained or provision for such maintenance is made.
23    Contracts for maintenance work shall be advertised for and
24let by the county board in county unit road districts and by

1shall be let to the lowest responsible bidder subject to the
2approval of the county superintendent of highways or the
3highway commissioner, and such contracts also shall be subject
4to approval by the Department.

7    Sec. 9-130. No person, firm, corporation or institution,
8public or private, shall plow or remove or cause to be plowed
9or removed ice or snow from any shopping center, parking lot,
10commercial or institutional service area or driveway or any
11other public or private service area or driveway and deposit or
12cause to be deposited such ice or snow upon a traffic lane,
13parking area, or paved shoulder of a public highway or along
14the shoulder or edge of a public highway. Such prohibition
15shall not pertain to a residential driveway or sidewalk.
16    Any person, firm, corporation or institution, public or
17private, who violates this Section is guilty of a petty
18offense.
