1 | AMENDMENT TO HOUSE BILL 5332

2 | AMENDMENT NO. ______. Amend House Bill 5332 on page 2, by | ||||||
3 | replacing lines 8 through 16 with the following:

4 | "Section 15. Associations; prohibitions. Notwithstanding | ||||||
5 | any provision of this Act or other provision of law, the | ||||||
6 | governing entity of a homeowners' association, common interest | ||||||
7 | community association, or condominium unit owners' association | ||||||
8 | shall not, by the adoption of any bylaw or the exercise of any | ||||||
9 | power, prohibit the ownership of an electric vehicle, prohibit | ||||||
10 | the continuous charging of an electric vehicle, or prohibit the | ||||||
11 | installation of an electric vehicle charging station unless | ||||||
12 | such installation would be physically impossible or present an | ||||||
13 | undue burden on the association. The governing entity of a | ||||||
14 | homeowners' association, common interest community | ||||||
15 | association, or condominium unit owners' association shall | ||||||
16 | not, by the adoption of any bylaw or the exercise of any power, | ||||||
17 | prohibit the installation or use of an electric vehicle |

2 | on page 3, line 15, by deleting "and"; and | ||||||
3 | on page 3, line 19, by replacing "area" with "area; and (iii) | ||||||
4 | responsibility for installation costs and utility costs | ||||||
5 | associated with ongoing use of charging stations".
