SYNOPSIS AS INTRODUCED:

    Amends the Civil Administrative Code of Illinois and the State Fire Marshal Act. Provides that each director of a department that issues an occupational or professional license and the State Fire Marshal are authorized to issue an expedited temporary occupational or professional license to a service member and the spouse of an active duty member of the Armed Forces of the United States. Provides that the temporary occupational or professional license shall be valid for 6 months after the date of issuance. Sets forth application requirements. Amends the School Code. Excludes service members and spouses of active duty members of the Armed Forces of the United States from the additional requirement that after January 1, 1988, an applicant for a corresponding teaching certificate in this State also shall be required to pass certain examinations.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Civil Administrative Code of Illinois is
5amended by adding Section 5-715 as follows:
 
6    (20 ILCS 5/5-715 new)
7    Sec. 5-715. Expedited temporary licensure for service
8members and spouses.
9    (a) In this Section, "service member" means any person who
10serves or has served in the United States Armed Forces or any
11reserve component of the United States Armed Forces or the
12National Guard of any state, commonwealth, or territory of the
13United States or the District of Columbia.
14    (b) Each director of a department that issues an
15occupational or professional license is authorized to issue an
16expedited temporary occupational or professional license to a
17service member. The temporary occupational or professional
18license shall be valid for 6 months after the date of issuance.
19The service member shall apply to the department in the format
20prescribed by the department. An application must include proof
21that:
22        (1) the applicant is a service member;
23        (2) the applicant holds a valid license for the

1    occupation or profession issued by another state,
2    commonwealth, possession, or territory of the United
3    States, the District of Columbia, or any foreign
4    jurisdiction;
5        (3) the applicant is assigned to a duty station in this
6    State or has established legal residence in this State; and
7        (4) a complete set of the applicant's fingerprints has
8    been submitted to the Department of State Police for
9    statewide and national criminal history checks.
10    (c) Each director of a department that issues an
11occupational or professional license is authorized to issue an
12expedited temporary occupational or professional license to
13the spouse of an active duty member of the Armed Forces of the

16The active duty member spouse shall apply to the department in

5    (d) A department may adopt any rules necessary for the
6implementation and administration of this Section.
 
7    Section 10. The State Fire Marshal Act is amended by adding
8Section 5 as follows:

7    Section 15. The School Code is amended by changing Section
821-11.1 as follows:
 
9    (105 ILCS 5/21-11.1)  (from Ch. 122, par. 21-11.1)
10    (Section scheduled to be repealed on June 30, 2013)
11    Sec. 21-11.1. Certificates for equivalent qualifications.
12An applicant who holds or is eligible to hold a teacher's
13certificate or license under the laws of another state or
14territory of the United States may be granted a corresponding
15teacher's certificate in Illinois on the written authorization
16of the State Board of Education and the State Teacher
17Certification Board upon the following conditions:
18        (1) That the applicant is at least 19 years of age, is
19    of good character, of good health, and a citizen of the
20    United States or legally present and authorized for
21    employment; and
22        (2) That the requirements for a similar teacher's
23    certificate in the particular state or territory were, at
24    the date of issuance of the certificate, substantially

1    equal to the requirements in force at the time the
2    application is made for the certificate in this State.
3    After January 1, 1988, unless the applicant is a service
4member or the spouse of an active duty member of the Armed
5Forces of the United States, in addition to satisfying the
6foregoing conditions and requirements, an applicant for a
7corresponding teaching certificate in Illinois also shall be
8required to pass the examinations required under the provisions
9of Section 21-1a as directed by the State Board of Education.
10For the purposes of this Section, "service member" means any
11person who serves or has served in the United States Armed
12Forces or any reserve component of the United States Armed
13Forces or the National Guard of any state, commonwealth, or
14territory of the United States or the District of Columbia.
15    In determining good character under this Section, any
16felony conviction of the applicant may be taken into
17consideration, but the conviction shall not operate as a bar to
18registration.
19    The State Board of Education in consultation with the State
20Teacher Certification Board shall prescribe rules and
21regulations establishing the similarity of certificates in
22other states and the standards for determining the equivalence
23of requirements.
24    This Section is repealed on June 30, 2013.
