AMENDMENT TO HOUSE BILL 5435

2    AMENDMENT NO. ______. Amend House Bill 5435, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Civil Administrative Code of Illinois is
6amended by adding Section 5-715 as follows:
 
7    (20 ILCS 5/5-715 new)
8    Sec. 5-715. Expedited temporary licensure for service
9members and spouses.
10    (a) In this Section, "service member" means any person who,
11at the time of application under this Section, is an active
12duty member of the United States Armed Forces or any reserve
13component of the United States Armed Forces or the National
14Guard of any state, commonwealth, or territory of the United
15States or the District of Columbia or whose active duty service
16concluded within the preceding 2 years before application.

1    In this Section, "spouse" includes any party to a civil
2union under the Illinois Religious Freedom Protection and Civil
3Union Act.
4    (b) Each director of a department that issues an
5occupational or professional license is authorized to and shall
6issue an expedited temporary occupational or professional
7license, other than a license for a physician under the Medical
8Practice Act of 1987 or a license for a dentist under the
9Illinois Dental Practice Act, to a service member who meets the
10requirements under this Section. The temporary occupational or
11professional license shall be valid for one year after the date
12of issuance or until a license is granted or a notice to deny a
13license is issued in accordance with rules adopted by the
14department issuing the license, whichever occurs first. No
15temporary occupational or professional license shall be
16renewed. The service member shall apply to the department on
17forms provided by the department. An application must include
18proof that:
19        (1) the applicant is a service member;
20        (2) the applicant holds a valid license in good
21    standing for the occupation or profession issued by another
22    state, commonwealth, possession, or territory of the
23    United States, the District of Columbia, or any foreign
24    jurisdiction and the requirements for licensure in the
25    other jurisdiction are determined by the department to be
26    substantially equivalent to the standards for licensure of

1    this State;
2        (3) the applicant is assigned to a duty station in this
3    State or has established legal residence in this State;
4        (4) a complete set of the applicant's fingerprints has
5    been submitted to the Department of State Police for
6    statewide and national criminal history checks, if
7    applicable to the requirements of the department issuing
8    the license; the applicant shall pay the fee to the
9    Department of State Police or to the fingerprint vendor for
10    electronic fingerprint processing; no temporary
11    occupational or professional license shall be issued to an
12    applicant if the statewide or national criminal history
13    check discloses information that would cause the denial of
14    an application for licensure under any applicable
15    occupational or professional licensing Act;
16        (5) the applicant is not ineligible for licensure
17    pursuant to Section 2105-165 of the Civil Administrative
18    Code of Illinois;
19        (6) the applicant has submitted an application for full
20    licensure; and
21        (7) the applicant has paid the required fee; fees shall
22    not be refundable.
23    (c) Each director of a department that issues an
24occupational or professional license is authorized to and shall

15        (7) the applicant has paid the required fee; fees shall

17    (d) All relevant experience of a service member in the
18discharge of official duties, including full-time and
19part-time experience, shall be credited in the calculation of
20any years of practice in an occupation or profession as may be
21required under any applicable occupational or professional
22licensing Act. All relevant training provided by the military
23and completed by a service member shall be credited to that
24service member as meeting any training or education requirement
25under any applicable occupational or professional licensing
26Act, provided that the training or education is determined by

1the department to be substantially equivalent to that required
2under any applicable Act and is not otherwise contrary to any
3other licensure requirement.
4    (e) A department may adopt any rules necessary for the
5implementation and administration of this Section and shall by
6rule provide for fees for the administration of this Section.
7In addition, a department shall develop forms to facilitate the
8expedited temporary license application process, as well as
9contact information for service members to use in making
10application for an expedited temporary license.
11    (f) The Department of Veterans' Affairs shall make copies
12of the forms and contact information described in subsection
13(e) of this Section available to service members in this
14State.".
