1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The State Finance Act is amended by adding | ||||||||||||||||||||||||||
5 | Section 5.811 as follows: | ||||||||||||||||||||||||||
6 | (30 ILCS 105/5.811 new) | ||||||||||||||||||||||||||
7 | Sec. 5.811. The Choose Life Fund. | ||||||||||||||||||||||||||
8 | Section 10. The Illinois Vehicle Code is amended by adding | ||||||||||||||||||||||||||
9 | Section 3-699 as follows: | ||||||||||||||||||||||||||
10 | (625 ILCS 5/3-699 new) | ||||||||||||||||||||||||||
11 | Sec. 3-699. Choose Life license plates. | ||||||||||||||||||||||||||
12 | (a) The Secretary, upon receipt of an application made in | ||||||||||||||||||||||||||
13 | the form prescribed by the Secretary, may issue special | ||||||||||||||||||||||||||
14 | registration plates designated as Choose Life license plates to | ||||||||||||||||||||||||||
15 | any person who wishes to demonstrate support of organizations | ||||||||||||||||||||||||||
16 | that encourage adoption as a positive choice for women with | ||||||||||||||||||||||||||
17 | unplanned or unwanted pregnancies. The special plates issued | ||||||||||||||||||||||||||
18 | under this Section shall be affixed only to passenger vehicles | ||||||||||||||||||||||||||
19 | of the first division and motor vehicles of the second division | ||||||||||||||||||||||||||
20 | weighing not more than 8,000 pounds. Plates issued under this | ||||||||||||||||||||||||||
21 | Section shall expire according to the multi-year procedure |

1 | established by Section 3-414.1 of this Code. | ||||||
2 | (b) The Secretary shall confer with Illinois Choose Life, | ||||||
3 | Inc. of Illinois regarding the design, color, and format of the | ||||||
4 | plates, which shall carry the words "Choose Life". | ||||||
5 | The Secretary may also allow the plates to be issued as | ||||||
6 | vanity plates or personalized plates under Section 3-405.1 of | ||||||
7 | this Code. The Secretary shall prescribe stickers or decals as | ||||||
8 | provided under Section 3-412 of this Code. | ||||||
9 | (c) An applicant for the special plates shall be charged a | ||||||
10 | $25 fee for original issuance in addition to the appropriate | ||||||
11 | registration fee. Of this $25 fee, $10 shall be deposited into | ||||||
12 | the Choose Life Fund and $15 shall be deposited into the | ||||||
13 | Secretary of State Special License Plate Fund, to be used by | ||||||
14 | the Secretary to help defray the administrative processing | ||||||
15 | costs. | ||||||
16 | For each registration renewal period, a $25 fee, in | ||||||
17 | addition to the appropriate registration fee, shall be charged. | ||||||
18 | Of this $25 fee, $23 shall be deposited into the Choose Life | ||||||
19 | Fund and $2 shall be deposited into the Secretary of State | ||||||
20 | Special License Plate Fund. | ||||||
21 | (d) The Choose Life Fund is created as a special fund in | ||||||
22 | the State treasury. All moneys in the Choose Life Fund shall be | ||||||
23 | distributed on a pro-rated basis at the beginning of each | ||||||
24 | fiscal year to all applying qualified non-governmental, | ||||||
25 | not-for-profit agencies whose services include counseling and | ||||||
26 | meeting the material needs of pregnant women who are planning |

1 | to place their children for adoption. No moneys may be | ||||||
2 | distributed to organizations described in subsection (f) of | ||||||
3 | this Section. Moneys shall be distributed to the applying | ||||||
4 | qualified agencies in each county in direct proportion to the | ||||||
5 | number of "Choose Life" registrations and renewals | ||||||
6 | attributable to that county. Any unused moneys in excess of 10% | ||||||
7 | of the moneys allocated to a qualified non-profit organization | ||||||
8 | shall be returned to the Choose Life Fund at the end of the | ||||||
9 | fiscal year to be aggregated and distributed with the next | ||||||
10 | fiscal year's distributions to that county's qualified | ||||||
11 | agencies. | ||||||
12 | (e) To apply to be determined a qualified agency and | ||||||
13 | receive the moneys available through the Choose Life Fund, an | ||||||
14 | organization must deliver to the Secretary a notarized | ||||||
15 | affidavit signed by a duly appointed representative of the | ||||||
16 | organization under penalties of perjury that states the | ||||||
17 | following is true and correct to the best of his or her | ||||||
18 | knowledge: | ||||||
19 | (1) The organization is a non-profit organization. | ||||||
20 | (2) The organization does not discriminate because of | ||||||
21 | race, marital status, gender, religion, national origin, | ||||||
22 | handicap, or age. | ||||||
23 | (3) The organization is committed to counseling | ||||||
24 | pregnant women about the option of adoption. | ||||||
25 | (4) The organization is not involved or associated with | ||||||
26 | any abortion activities, including counseling for or |

1 | referrals to abortion clinics, providing medical | ||||||
2 | abortion-related procedures, or pro-abortion advertising. | ||||||
3 | (5) The organization does not charge women for any | ||||||
4 | services received. | ||||||
5 | (6) The organization understands and agrees that no | ||||||
6 | more than 60% of the moneys received may be used for the | ||||||
7 | material needs of pregnant women who are planning to place | ||||||
8 | their children for adoption, including, but not limited to, | ||||||
9 | clothing, housing, medical care, food, utilities, and | ||||||
10 | transportation. These moneys may also be expended on birth | ||||||
11 | mothers up to 60 days after delivery and on infants | ||||||
12 | awaiting placement with adoptive parents. Agencies that | ||||||
13 | receive these moneys shall use no more than 40% of the | ||||||
14 | moneys received to enhance their adoption efforts, | ||||||
15 | including, but not limited to counseling, training, and | ||||||
16 | advertising. | ||||||
17 | (7) These moneys may not be used for administrative | ||||||
18 | expenses, legal expenses, or capital expenditures. | ||||||
19 | (8) The organization understands and agrees that any | ||||||
20 | unused moneys at the end of the fiscal year that exceed 10% | ||||||
21 | of the moneys received by the organization during the | ||||||
22 | fiscal year must be returned to the Choose Life Fund to be | ||||||
23 | aggregated and distributed with the next fiscal year | ||||||
24 | distribution to that county's qualified applicants. | ||||||
25 | (9) The organization understands and agrees that each | ||||||
26 | organization that receives funds must submit a notarized |

1 | annual affidavit attesting the funds received were used in | ||||||
2 | the manner described in this Section. | ||||||
3 | (f) Moneys in the Choose Life Fund may not be distributed | ||||||
4 | to any organization involved or associated with any abortion | ||||||
5 | activities, including counseling for or referrals to abortion | ||||||
6 | clinics, providing medical abortion-related procedures, or | ||||||
7 | pro-abortion advertising. Funds may not be distributed to any | ||||||
8 | organization that charges women for any services received. | ||||||
9 | (g) 60% of the moneys received from the Choose Life Fund | ||||||
10 | may be used for the material needs of pregnant women who are | ||||||
11 | planning to place their children for adoption, including, but | ||||||
12 | not limited to, clothing, housing, medical care, food, | ||||||
13 | utilities, and transportation. These moneys may also be | ||||||
14 | expended on birth mothers up to 60 days after delivery and | ||||||
15 | infants awaiting placement with adoptive parents. Agencies | ||||||
16 | that receive these moneys shall use no more than 40% of the | ||||||
17 | moneys received from the Choose Life Fund to enhance their | ||||||
18 | adoption efforts, including, but not limited to counseling, | ||||||
19 | training, and advertising. These moneys may not be used for | ||||||
20 | administrative expenses, legal expenses, or capital | ||||||
21 | expenditures. | ||||||
22 | (h) Each organization that receives moneys from the Choose | ||||||
23 | Life Fund must submit to a notarized annual affidavit attesting | ||||||
24 | the moneys received were used in the manner described in this | ||||||
25 | Section.
