SYNOPSIS AS INTRODUCED:
 
New Act
20 ILCS 405/405-280  was 20 ILCS 405/67.15

    Creates the State Vehicle Use Act. Provides that each State agency shall designate a vehicle use officer who shall assist the State agency in drafting a vehicle use policy. Sets forth the required contents of the vehicle use policy. Provides that, for cases in which a State employee would otherwise use a State-owned vehicle but uses his or her own vehicle instead, a State agency may reimburse the State employee for automobile travel expenses. Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that the Department of Central Management Services shall evaluate the availability and cost of GPS systems that State agencies may be able to use to track State-owned motor vehicles. Provides that the Department shall make available to the public vehicle cost data and an annual vehicle breakeven analysis on its Internet website. Provides that the Department may not make any new motor vehicle purchases until the Department has promulgated rules setting forth procedures to condition the purchase of new motor vehicles on a determination of need based on a breakeven analysis. Effective January 1, 2013.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the State
5Vehicle Use Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Constitutional officers" means the officers created under
8Article V of the Illinois Constitution.
9    "Department" means the Department of Central Management
10Services.
11    "Division of Vehicles" means the Division of Vehicles
12within the Department of Central Management Services.
13    "State agency" means all departments, officers,
14commissions, boards, institutions, and bodies politic and
15corporate of the State. "State agency" does not include the
16judicial branch, including, without limitation, the several
17courts of the State, the offices of the clerk of the supreme
18court and the clerks of the appellate court, and the
19Administrative Office of the Illinois Courts, the legislature
20or its committees or commissions, or units of local government.
21    "Vehicle" means any motor vehicle belonging to the State of
22Illinois or any agency, board, commission, branch, or
23department thereof or controlled thereby, including

1automobiles, motorcycles, trucks, and other types of
2automotive equipment.
 
3    Section 10. Vehicle use officer; vehicle use policy.
4    (a) Each State agency shall designate a vehicle use officer
5to monitor the use of State-owned vehicles by that State
6agency.
7    (b) Each State agency, with the assistance of the vehicle
8use officer, shall draft a vehicle use policy. All vehicle use
9policies, other than those drafted by a constitutional officer,
10shall be submitted to the Division of Vehicles within the
11Department of Central Management Services and shall be made
12publicly available on the Department's official Internet
13website. A vehicle use officer for a constitutional officer
14shall make the vehicle use policy publicly available on the
15constitutional officer's official Internet website. A vehicle
16use policy shall include the following:
17        (1) a policy concerning take-home vehicles, including
18    requirements for emergency use of take-home vehicles and
19    restrictions on the use of take-home vehicles solely for
20    commuting; and
21        (2) procedures regarding daily vehicle use logs and
22    mileage recording.
 
23    Section 20. Mileage reimbursement. For cases in which a
24State employee would otherwise use a State-owned vehicle but

1uses his or her own vehicle instead, a State agency may
2reimburse a State employee for automobile travel expenses in
3accordance with the State Travel Regulations and Reimbursement
4Rates adopted under Section 12-2 of the State Finance Act.
 
5    Section 25. The Department of Central Management Services
6Law of the Civil Administrative Code of Illinois is amended by
7changing Section 405-280 as follows:

9    Sec. 405-280. State garages; passenger cars.
10    (a) To supervise and administer all State garages used for
11the repair, maintenance, or servicing of State-owned motor
12vehicles except those operated by any State college or
13university or by the Illinois Mathematics and Science Academy;
14and to acquire, maintain, and administer the operation of the
15passenger cars reasonably necessary to the operations of the
16executive department of the State government. To this end, the
17Department shall adopt regulations setting forth guidelines
18for the acquisition, use, maintenance, and replacement of motor
19vehicles, including the use of ethanol blended gasoline
20whenever feasible, used by the executive department of State
21government; shall occupy the space and take possession of the
22personnel, facilities, equipment, tools, and vehicles that are
23in the possession or under the administration of the former
24Department of Administrative Services for these purposes on

1July 13, 1982 (the effective date of Public Act 82-789); and
2shall, from time to time, acquire any further, additional, and
3replacement facilities, space, tools, and vehicles that are
4reasonably necessary for the purposes described in this
5Section.
6    (b) The Department shall evaluate the availability and cost
7of GPS systems that State agencies may be able to use to track
8State-owned motor vehicles.
9    (c) The Department shall make available to the public on
10its Internet website the following information:
11        (1) vehicle cost data, organized by individual vehicle
12    and by State agency, and including repair, maintenance,
13    fuel, insurance, and other costs, as well as whether
14    required vehicle inspections have been performed; and
15        (2) an annual vehicle breakeven analysis, organized by
16    individual vehicle and by State agency, comparing the
17    number of miles a vehicle has been driven with the total
18    cost of maintaining the vehicle.
19Each State agency shall cooperate with the Department in
20furnishing the information necessary for the implementation of
21this subsection within a timeframe specified by the Department.
22    (d) Beginning on the effective date of this amendatory Act
23of the 97th General Assembly, and notwithstanding any provision
24of law to the contrary, the Department may not make any new
25motor vehicle purchases until the Department has promulgated
26rules, in accordance with the Illinois Administrative

1Procedure Act, setting forth procedures to condition the
2purchase of new motor vehicles on a determination of need based
3on a breakeven analysis demonstrating that the purchase of a
4new motor vehicle would be cost-effective to the State.

6    Section 99. Effective date. This Act takes effect January
