1    AN ACT concerning construction.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Vertical Construction Masonry Composition Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Commercial building" means any building, other than a
8residential building for 4 or fewer families, that is
9constructed for the purpose of generating revenue for the
10owner.
11    "Masonry construction" means construction of commercial
12buildings by utilizing concrete, mortar, brick, stone, and
13similar materials.
14    "Vertical commercial construction" means construction of a
15commercial building rising 15 or more feet above the surface of
16the ground.
 
17    Section 10. Vertical construction; masonry component
18requirement.
19    (a) Except as provided in subsection (b), all vertical
20commercial construction started after July 1, 2013 must include
21masonry construction for at least 15% of the building's
22components.

1    (b) The masonry component requirement established under
2subsection (a) may be reduced to a lesser percentage upon
3certification by an architect licensed under the Illinois
4Architecture Practice Act of 1989 or a structural engineer
5licensed under the Structural Engineering Practice Act of 1989
6that the statutorily required percentage of masonry components
7would be structurally deficient in relation to the size of the
8building. A reduction under this subsection may only reduce the
9masonry component of the building to the amount necessary to
10maintain the structural integrity of the building.
