SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-2.01

    Amends the Medical Assistance Article of the Illinois Public Aid Code. In regard to the internet-based Medicaid accountability program, provides that the Department of Healthcare and Family Services (rather than the Director of the Department of Healthcare and Family Services) shall implement (rather than shall be authorized to implement) the program. Substitutes all references to "Director" with "Department". Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-2.01 as follows:
 
6    (305 ILCS 5/5-2.01)
7    Sec. 5-2.01. Medicaid accountability through transparency
8program.
9    (a) Internet-based transparency program. The Director of
10the Department of Healthcare and Family Services shall be
11authorized to implement a program under which the Department
12Director shall make available through the Department's public
13Internet website information on medical claims reimbursed
14under the State's medical assistance program insofar as such
15information has been de-identified in accordance with
16regulations promulgated pursuant to the Illinois Health
17Insurance Portability and Accountability Act. In implementing
18the program, the Department Director shall ensure the
19following:
20        (1) The information made so available shall be in a
21    format that is easily accessible, useable, and
22    understandable to the public, including individuals
23    interested in improving the quality of care provided to

1    individuals eligible for items and services under this
2    Article, researchers, health care providers, and
3    individuals interested in reducing the prevalence of waste
4    and fraud under this Article.
5        (2) The information made so available shall be as
6    current as deemed practical by the Department Director and
7    shall be updated at least once per calendar quarter.
8        (3) The information made so available shall be
9    aggregated to a level to ensure patient confidentiality,
10    but shall, to the extent feasible, allow for posting of
11    information by provider or vendor name and county, number
12    of individuals served, total patient visits, payment for
13    bills submitted, average cost for bills submitted,
14    adjustments to payments, and total amounts paid.
15        (4) The Department Director periodically solicits
16    comments from a sampling of individuals who access the
17    information through the program on how to best improve the
18    utility of the program.
19    (b) Use of contractor. For purposes of implementing the
20program under subsection (a) of this Section and ensuring the
21information made available through the program is periodically
22updated, the Department Director may select and enter into a
23contract with a public or private entity meeting the criteria
24and qualifications the Department Director determines
25appropriate.
26    (c) Annual Reports. Not later than 12 months after the

1effective date of this amendatory Act of the 96th General
2Assembly and annually thereafter, the Department Director
3shall submit to the General Assembly a report on the status of
4the program authorized under subsection (a). The report shall
5include details including, but not limited to, the estimated or
6actual costs of developing and maintaining the reporting
7system, the actual or potential benefit or adverse consequences
8associated with the system, and, if applicable, the extent to
9which information made available through the program is
10accessed and the extent to which comments received under
11paragraph (4) of subsection (a) of this Section were used to
12improve the utility of the program.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.
