AMENDMENT TO SENATE BILL 958

2    AMENDMENT NO. ______. Amend Senate Bill 958 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Section 6-130 as follows:
 
6    (605 ILCS 5/6-130)  (from Ch. 121, par. 6-130)
7    Sec. 6-130. (a) Notwithstanding any other provision of this
8Act to the contrary, no township road district may continue in
9existence if the roads forming a part of the district do not
10exceed a total of 4 miles in length. For purposes of this
11Section, the roads forming a part of a township road district
12include those roads maintained by the district, regardless of
13whether or not those roads are owned by the township. On the
14first Tuesday in April of 1975, or of any subsequent year next
15succeeding the reduction of a township road system to a total
16mileage of 4 miles or less, each such township road district

1shall, by operation of law, be abolished. The roads comprising
2that district at that time shall thereafter be administered by
3the township board of trustees by contracting with the county,
4a municipality or a private contractor. The township board of
5trustees shall assume all taxing authority of a township road
6district abolished under this Section.
7    (b) In counties having a population of more than 500,000 as
8determined by the 2010 federal census, no township road
9district may continue in existence if the roads forming a part
10of the district do not exceed a total of 32 miles in length.
11For purposes of this subsection (b), the roads forming a part
12of a township road district include those roads maintained by
13the district, regardless of whether or not those roads are
14owned by the township. On the first Tuesday in April after the
15effective date of this amendatory Act of the 97th General
16Assembly, or of any subsequent year next succeeding the
17reduction of a township road system to a total mileage of 32
18miles or less, each such township road district under this
19subsection (b) shall, by operation of law, be abolished. The
20roads comprising that district at that time shall thereafter be
21administered by the township board of trustees by contracting
22with the county, a municipality or a private contractor. The
23township board of trustees shall assume all taxing authority of
24a township road district abolished under this subsection (b).
