AMENDMENT TO SENATE BILL 1350

2    AMENDMENT NO. ______. Amend Senate Bill 1350 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Truth in Health Care Professional Services
5Act is amended by changing Section 10 as follows:
 
6    (225 ILCS 145/10)
7    Sec. 10. Definitions. For purposes of this Act:
8    "Advertisement" denotes any communication or statement,
9whether printed, electronic, or oral, that names the health
10care professional in relation to his or her practice,
11profession, or institution in which the individual is employed,
12volunteers, or otherwise provides health care services. This
13includes business cards, letterhead, patient brochures,
14e-mail, Internet, audio, and video, and any other communication
15or statement used in the course of business.
16    "Deceptive" or "misleading" includes, but is not limited

1to, any advertisement or affirmative communication or
2representation for health care services that misstates,
3falsely describes, or falsely represents the health care
4professional's skills, training, expertise, education, board
5certification, or licensure.
6    "Health care professional" means any person who treats
7human ailments and is subject to licensure or regulation by the
8State, including students and residents. "Health care
9professional" does not include an individual licensed as a
10dentist under the Illinois Dental Practice Act.
11    "Licensee" means a health care professional who holds an
12active license with the licensing board governing his or her
13practice in this State.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.".
