1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Carbon
5Capture and Sequestration Legislation Commission Act.
 
6    Section 5. Definitions. As used in this Act:
7    "CO2" means carbon dioxide.
8    "Commission" means the Carbon Capture and Sequestration
9Legislation Commission.
10    "Director" means the Executive Director of the Illinois
11Commerce Commission.
 
12    Section 10. Creation of the Carbon Capture and
13Sequestration Legislation Commission.
14    (a) The Carbon Capture and Sequestration Legislation
15Commission is created and shall consist of 11 members,
16including the Director, who shall serve as the ex-officio
17chairperson of the Commission.
18    (b) The remaining 10 members of the Commission shall be
19appointed as follows:
20        (1) one member shall be appointed by the Speaker of the
21    House of Representatives;
22        (2) one member shall be appointed by the President of

1    the Senate;
2        (3) one member shall be appointed by the Minority
3    Leader of the House of Representatives;
4        (4) one member shall be appointed by the Minority
5    Leader of the Senate;
6        (5) one member shall be the Director of the Illinois
7    Power Agency, or his or her designee; and
8        (6) 6 members shall be appointed by the Governor.
9    (c) The appointments made by the Governor shall include one
10member with legal expertise, one member with engineering
11expertise, one member with financial expertise, one member
12representing the employer community, one member representing
13production agriculture land owners, and one member
14representing the environmental community.
15    (d) The Director may retain services from outside parties
16with legal, engineering, and financial expertise to assist the
17Commission in carrying out its duties.
18    (e) The Illinois Power Agency may assist the Director in
19staffing and administering the Commission.
20    (f) Commission members are not eligible to receive
21compensation or reimbursement of expenses.
 
22    Section 15. Report on carbon capture and sequestration
23legislation.
24    (a) The Commission shall file a report no later than
25December 31, 2012 with the General Assembly on all issues

1deemed appropriate to carbon capture and sequestration
2legislation, including, but not limited to, the following:
3        (1) Ownership of the CO2.
4        (2) Liability for release of CO2.
5        (3) Acquisition and ownership of pore space.
6        (4) Procedures and safeguards for the transportation
7    and sequestration of CO2.
8        (5) Methodology to establish any necessary fees,
9    costs, or offsets.
10        (6) Potential use of CO2.
11        (7) Construction of pipelines.
12        (8) Coordination with federal and state laws and
13    regulations.
14        (9) Coordination with the Illinois Department of
15    Natural Resources, the Illinois Environmental Protection
16    Agency, the United States Environmental Protection Agency,
17    and other applicable regulatory agencies and commissions.
18    (b) The Commission shall be abolished upon filing its
19report with the General Assembly.
 
20    Section 20. Repealer. This Act is repealed on January 1,
212013.
 
22    Section 99. Effective date. This Act takes effect upon
23becoming law.
