AMENDMENT TO SENATE BILL 1609

2    AMENDMENT NO. ______. Amend Senate Bill 1609 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Urban Weatherization Initiative Act is
5amended by changing Section 40-40 as follows:
 
6    (30 ILCS 738/40-40)
7    Sec. 40-40. Weatherization Initiative Board.
8    (a) The Weatherization Initiative Board is created within
9the Department. The Board must approve or deny all grants from
10the Fund.
11    (a-5) Notwithstanding any other provision of this Article,
12the Board has the authority to direct the Department to
13authorize the awarding of grants to applicants serving areas or
14populations not included in the target areas and populations
15set forth in Section 40-25 if the Board determines that there
16are special circumstances involving the areas or populations

1served by the applicant.
2    (b) The Board shall consist of 5 voting members appointed
3by the Governor with the advice and consent of the Senate. The
4initial members shall have terms as follows as designated by
5the Governor: one for one year, one for 2 years, one for 3
6years, one for 4 years, and one for 5 years, or until a
7successor is appointed and qualified. Thereafter, members
8shall serve 5-year terms or until a successor is appointed and
9qualified. The voting members shall elect a voting member to
10serve as chair for a one-year term. Vacancies shall be filled
11in the same manner for the balance of a term.
12    (c) The Board shall also have 12 4 non-voting ex officio
13members appointed as follows: 3 Representatives one
14Representative appointed by the Speaker of the House, 3
15Representatives one Representative appointed by the House
16Minority Leader, 3 Senators one Senator appointed by the
17President of the Senate, and 3 Senators one Senator appointed
18by the Senate Minority Leader, each to serve at the pleasure of
19the appointing authority.
20    (d) Members shall receive no compensation, but may be
21reimbursed for necessary expenses from appropriations to the
22Department available for that purpose.
23    (e) The Board may adopt rules under the Illinois
24Administrative Procedure Act.
25    (f) A quorum of the Board is at least 3 voting members, and
26the affirmative vote of at least 3 voting members is required

1for Board decisions and adoption of rules.
2    (g) The Department shall provide staff and administrative
3assistance to the Board.
4    (h) By December 31 of each year, the Board shall file an
5annual report with the Governor and the General Assembly
6concerning the Initiative, grants awarded, and grantees and
7making recommendations for any changes needed to enhance the
8effectiveness of the Initiative.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.".
