AMENDMENT TO SENATE BILL 1633

2    AMENDMENT NO. ______. Amend Senate Bill 1633, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The State Finance Act is amended by changing
6Sections 6z-51 and 6z-81 as follows:
 
7    (30 ILCS 105/6z-51)
8    Sec. 6z-51. Budget Stabilization Fund.
9    (a) The Budget Stabilization Fund, a special fund in the
10State Treasury, shall consist of moneys appropriated or
11transferred to that Fund, as provided in Section 6z-43 and as
12otherwise provided by law. All earnings on Budget Stabilization
13Fund investments shall be deposited into that Fund.
14    (b) The State Comptroller may direct the State Treasurer to
15transfer moneys from the Budget Stabilization Fund to the
16General Revenue Fund in order to meet cash flow deficits

1resulting from timing variations between disbursements and the
2receipt of funds within a fiscal year. Any moneys so borrowed
3in any fiscal year other than Fiscal Year 2011 shall be repaid
4by June 30 of the fiscal year in which they were borrowed. Any
5moneys so borrowed in Fiscal Year 2011 shall be repaid no later
6than July 15, 2011.

9    (30 ILCS 105/6z-81)
10    Sec. 6z-81. Healthcare Provider Relief Fund.
11    (a) There is created in the State treasury a special fund
12to be known as the Healthcare Provider Relief Fund.
13    (b) The Fund is created for the purpose of receiving and
14disbursing moneys in accordance with this Section.
15Disbursements from the Fund shall be made only as follows:
16        (1) Subject to appropriation, for payment by the
17    Department of Healthcare and Family Services or by the
18    Department of Human Services of medical bills and related
19    expenses, including administrative expenses, for which the
20    State is responsible under Titles XIX and XXI of the Social
21    Security Act, the Illinois Public Aid Code, the Children's
22    Health Insurance Program Act, the Covering ALL KIDS Health
23    Insurance Act, and the Senior Citizens and Disabled Persons
24    Property Tax Relief and Pharmaceutical Assistance Act.
25        (2) For repayment of funds borrowed from other State

1    funds or from outside sources, including interest thereon.
2    (c) The Fund shall consist of the following:
3        (1) Moneys received by the State from short-term
4    borrowing pursuant to the Short Term Borrowing Act on or
5    after the effective date of this amendatory Act of the 96th
6    General Assembly.
7        (2) All federal matching funds received by the Illinois
8    Department of Healthcare and Family Services as a result of
9    expenditures made by the Department that are attributable
10    to moneys deposited in the Fund.
11        (3) All federal matching funds received by the Illinois
12    Department of Healthcare and Family Services as a result of
13    federal approval of Title XIX State plan amendment
14    transmittal number 07-09.
15        (4) All other moneys received for the Fund from any
16    other source, including interest earned thereon.
17    (d) In addition to any other transfers that may be provided
18for by law, on the effective date of this amendatory Act of the
1997th General Assembly, or as soon thereafter as practical, the
20State Comptroller shall direct and the State Treasurer shall
21transfer the sum of $365,000,000 from the General Revenue Fund
22into the Healthcare Provider Relief Fund.

24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
