Amends the Illinois Municipal Code. Provides that municipalities may license, tax, locate, regulate, or prohibit all places of business of dealers in second-hand articles, including but without limitation, pawnbrokers and dealers in junk, dismantled or wrecked motor vehicles, precious or other metals, rags, or any other second-hand article. Further provides that a municipality may license, tax, regulate, or prohibit hawkers, peddlers, itinerant merchants, and transient vendors of merchandise. Makes other changes. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Municipal Code is amended by |
5 | | changing Sections 11-42-3 and 11-42-5 as follows:
|

7 | | Sec. 11-42-3. Regulation of second-hand dealers and |
8 | | certain vendors. |
9 | | (a) The corporate authorities of each municipality may |
10 | | license,
tax, locate, and regulate , or prohibit all places of |
11 | | business of dealers in second-hand articles, including, |
12 | | without limitation, pawnbrokers and dealers in junk,
|
13 | | dismantled or wrecked motor vehicles or parts thereof, precious |
14 | | or other metals, rags, or and any
second-hand article |
15 | | whatsoever.

16 | | (b) The corporate authorities of each municipality may |
17 | | license, tax, regulate, or prohibit hawkers, peddlers, |
18 | | itinerant merchants, and transient vendors of merchandise. |
19 | | The corporate authorities also may forbid any person from |
20 | | purchasing or
receiving from minors without the written consent |
21 | | of their parents or
guardians, any article whatsoever.
