1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-292 as follows:
 
7    (20 ILCS 405/405-292)
8    Sec. 405-292. Business processing reengineering; planning
9for a more efficient government.
10    (a) The Department may recommend shall be responsible for
11recommending to the Governor efficiency initiatives to
12reorganize, restructure, and reengineer the business processes
13of the State. In performing this responsibility the Department
14shall have the power and duty to do the following:
15        (1) propose the transfer, consolidation,
16    reorganization, restructuring, reengineering, or
17    elimination of programs, processes, or functions in order
18    to attain efficiency in operations and cost savings through
19    the efficiency initiatives;
20        (2) control the procurement of contracted services in
21    connection with the efficiency initiatives to assist in the
22    analysis, design, planning, and implementation of
23    proposals approved by the Governor to attain efficiency in

1    operations and cost savings; and
2        (3) establish the amount of cost savings to be realized
3    by State agencies from implementing the efficiency
4    initiatives, which shall be paid to the Department for
5    deposit into the Efficiency Initiatives Revolving Fund,
6    except that any cost savings realized by the Illinois
7    Department of Transportation shall be deposited into the
8    State Construction Account Fund.
9    (b) For the purposes of this Section, "State agencies"
10means all departments, boards, commissions, and agencies of the
11State of Illinois subject to the Governor.

13    Section 10. The State Finance Act is amended by changing
14Sections 6p-3, 6p-5, 6q, and 8.32 as follows:

16    Sec. 6p-3. (a) The State Surplus Property Revolving Fund
17shall be initially financed by a transfer of funds from the
18General Revenue Fund. Thereafter all fees and other monies
19received by the Department of Central Management Services from
20the sale or transfer of surplus or transferable property
21pursuant to the "State Property Control Act" and "An Act to
22create and establish a State Agency for Federal Surplus
23Property, to prescribe its powers, duties and functions",
24approved August 2, 1965, as amended, shall be paid into the

1State Surplus Property Revolving Fund. Except as provided in
2paragraph (e) of this Section, the money in this fund shall be
3used by the Department of Central Management Services as
4reimbursement for expenditures incurred in relation to the sale
5of surplus or transferable property.
6    (b) If at the end of the lapse period the balance in the
7State Surplus Property Revolving Fund exceeds the amount of
8$500,000, all monies in excess of that amount shall be
9transferred and deposited into the General Revenue Fund.
10    (c) Provided, however, that the fund established by this
11Section shall contain a separate account for the deposit of all
12proceeds resulting from the sale of Federal surplus property,
13and the proceeds of this separate account shall be used solely
14to reimburse the Department of Central Management Services for
15expenditures incurred in relation to the sale of Federal
16surplus property.
17    (d) Any funds on deposit in the State Agency for Surplus
18Property Utilization Fund on the effective date of this
19amendatory Act of 1983 shall be transferred to the Federal
20account of the State Surplus Property Revolving Fund.
21    (e) Revenues received from the sale of wastepaper through
22paper recycling programs shall be placed into a separate
23account in the Fund and shall be used to offset costs to the
24Department of establishing and operating wastepaper recycling
25programs. At the end of each calendar quarter, any amounts in
26the separate account that have not been used or designated for

1use shall be transferred to the Paper and Printing Revolving
2Fund.

5    Sec. 6p-5. Efficiency Initiatives Revolving Fund. Amounts
6designated by the Director of Central Management Services and
7approved by the Governor as savings from the efficiency
8initiatives authorized by Section 405-292 of the Department of
9Central Management Services Law of the Civil Administrative
10Code of Illinois shall be paid into the Efficiency Initiatives
11Revolving Fund. State agencies shall pay these amounts into the
12Efficiency Initiatives Revolving Fund from the line item
13appropriations where the cost savings are anticipated to occur.
14The money in this fund shall be used by the Department for
15expenses incurred in connection with the efficiency
16initiatives authorized by Section 405-292 of the Department of
17Central Management Services Law of the Civil Administrative
18Code of Illinois or for payment of Facilities Management
19Revolving Fund billings issued to the Department, as authorized
20under Section 6z-65. On or before August 31, 2004, and each
21August 31 thereafter, the Department of Central Management
22Services shall transfer excess balances in the Efficiency
23Initiatives Revolving Fund to the General Revenue Fund. As used
24in this Section, "excess balances" means amounts in excess of
25the amount necessary to fund current and anticipated efficiency

1initiatives.
2    Notwithstanding any other provision of law, in addition to
3any other transfers that may be provided by law, on July 1,
42012, or as soon thereafter as practical, the State Comptroller
5shall direct and the State Treasurer shall transfer the
6remaining balance from the Efficiency Initiatives Revolving
7Fund into the General Revenue Fund. Upon completion of the
8transfer, the Efficiency Initiatives Revolving Fund is
9dissolved, and any future deposits due to that Fund and any
10outstanding obligations or liabilities of the Fund pass to the
11General Revenue Fund.

14    Sec. 6q. (a) All moneys received by the Department of
15Central Management Services as an incident to the operation of
16paper and printing warehouses, including fees received for wall
17certificates from the Department of Professional Regulation,
18shall be paid into the paper and printing revolving fund.
19    (b) All funds in the special wastepaper recycling account
20in the State Surplus Property Revolving Fund not used or
21designated for recycling expenses shall be paid into the Paper
22and Printing Revolving Fund and held in a special account for
23recycled paper expenses.
24    (c) Notwithstanding any other provision of law, in addition
25to any other transfers that may be provided by law, on July 1,

12012, or as soon after as practical, the State Comptroller
2shall direct and the State Treasurer shall transfer the

11    Sec. 8.32. All moneys received by the Minority and Female
12Business Enterprise Council, or by the Department of Central
13Management Services on behalf of the Council or the
14Department's Minority and Female Business Enterprise Division,
15from grants, donations, seminar registration fees, and the sale
16of directories, lists and other such information, shall be
17deposited into the Minority and Female Business Enterprise Fund
18in the State treasury. Expenses of the Council or the
19Department's Minority and Female Business Enterprise Division
20may be paid from this Fund.
21    Notwithstanding any other provision of law, in addition to
22any other transfers that may be provided by law, on July 1,
232012, or as soon thereafter as practical, the State Comptroller
24shall direct and the State Treasurer shall transfer the

10    Section 15. The State Finance Act is amended by repealing
11Sections 5.36, 5.298, and 5.615.
