| 1 | AMENDMENT TO SENATE BILL 3345

| 2 | AMENDMENT NO. ______. Amend Senate Bill 3345 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Clerks of Courts Act is amended by adding | ||||||
| 5 | Section 27.3f as follows: | ||||||
| 6 | (705 ILCS 105/27.3f new) | ||||||
| 7 | Sec. 27.3f. Pro-rata distribution of costs, fees, and | ||||||
| 8 | fines. Whenever the payment of costs, fees, fines, or other | ||||||
| 9 | financial obligations imposed upon a defendant in any felony, | ||||||
| 10 | misdemeanor, traffic, ordinance, or conservation offense is | ||||||
| 11 | less than the total amount as required by law or imposed by the | ||||||
| 12 | court, the clerk of the court shall apply the amount paid on a | ||||||
| 13 | pro-rata basis to each cost, fee, fine, or other financial | ||||||
| 14 | obligation assessed in the case. This pro-rata distribution | ||||||
| 15 | shall apply to any initial payments and each subsequent payment | ||||||
| 16 | made by the defendant.".
