AMENDMENT TO SENATE BILL 3384

2    AMENDMENT NO. ______. Amend Senate Bill 3384 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 11-709.2 and by adding Section 11-709.4 as
6follows:
 
7    (625 ILCS 5/11-709.2)
8    Sec. 11-709.2. Bus on shoulder pilot program.
9    (a) For purposes of this Section, "bus on shoulders" is the
10use of specifically designated shoulders of roadways by
11authorized transit buses. The shoulders may be used by transit
12buses at times and locations as set by the Department in
13cooperation with the Regional Transportation Authority and the
14Suburban Bus Division of the Regional Transportation
15Authority.
16    (b) Commencing on the effective date of this amendatory Act

1of the 97th General Assembly, the Department along with the
2Regional Transportation Authority and Suburban Bus Division of
3the Regional Transportation Authority in cooperation with the
4Illinois State Police shall establish a 5-year pilot program
5within the boundaries of the Regional Transportation Authority
6for transit buses on highways and shoulders. The pilot program
7may be implemented on shoulders of highways as designated by
8the Department in cooperation with the Regional Transportation
9Authority and Suburban Bus Division of the Regional
10Transportation Authority and any affected local highway
11authorities. The Department may adopt rules necessary for
12approving, establishing, operating, evaluating, and reporting
13on the pilot program for transit buses to use roadway
14shoulders.
15    (c) After the pilot program established under subsection
16(b) of this Section has been operating for 2 years, the
17Department in cooperation with the Regional Transit Authority,
18the Suburban Bus Division of the Regional Transportation
19Authority, and the Illinois State Police shall issue a report
20to the General Assembly on the effectiveness of the bus on
21shoulders pilot program.

1Act of the 97th General Assembly, the Department along with the
2Regional Transportation Authority and Suburban Bus Division of
3the Regional Transportation Authority in cooperation with the
4Kane County Division of Transportation shall establish a 5-year
5pilot program on the Randall Road corridor in Kane County for
6transit buses. The Department may adopt rules for approving,
7establishing, operating, evaluating, and reporting on the
8pilot program for transit buses to use roadway shoulders.
9    (b) After the pilot program established under subsection
10(a) of this Section has been operating for 2 years, the
11Department, in cooperation with the Regional Transit
12Authority, the Suburban Bus Division of the Regional
13Transportation Authority, and the Kane County Division of
14Transportation shall issue a report to the General Assembly on
15the effectiveness of the bus pilot program.
16     (c) The pilot program is subject to appropriation and
17approval by the Department, the Regional Transportation
18Authority, the Suburban Bus Division of the Regional
19Transportation Authority, and the Kane County Division of
20Transportation.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.".
