Amends the Local Governmental and Governmental Employees Tort
Immunity Act. Provides that neither a local public entity nor a public employee is liable for an injury where the liability is based on the existence of a condition of any public property intended or permitted to be used for library purposes, unless that local entity or public employee is guilty of willful and wanton conduct proximately causing the injury. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Local Governmental and Governmental |
5 | | Employees Tort
Immunity Act is amended by adding Section |
6 | | 3-106.1 as follows: |
7 | | (5 ILCS 5/3-106.1 new) |
8 | | Sec. 3-106.1. Property used for public library purposes. |
9 | | Neither a local public entity nor a public employee is liable |
10 | | for an injury where the liability is based on the existence of |
11 | | a condition of any public property intended or permitted to be |
12 | | used for library purposes, including, but not limited to, open |
13 | | areas, buildings, grounds, rooms, or motor vehicles, unless |
14 | | that local entity or public employee is guilty of willful and |
15 | | wanton conduct proximately causing the injury.

16 | | Section 99. Effective date. This Act takes effect upon |
17 | | becoming law.
