55 ILCS 5/5-1134 new

    Amends the Counties Code. Authorizes the county board or board of county commissioners of a county to prohibit the use of coal tar pavement product on all roadways, driveways, and parking lots within the county. Defines "coal tar" and "coal tar pavement product".

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-1134 as follows:
 
6    (55 ILCS 5/5-1134 new)
7    Sec. 5-1134. Use of coal tar. The county board or board of
8county commissioners of a county may prohibit the use of coal
9tar pavement products on all roadways, driveways, and parking
10lots within the county. For the purposes of this Section, "coal
11tar" means a viscous substance obtained by the combustion of
12coal and containing levels of polycyclic aromatic hydrocarbons
13in excess of 10,000 milligrams per kilogram. "Coal tar"
14includes, but is not limited to, refined coal tar, high
15temperature coal tar, or coal tar pitch. "Coal tar" does not
16include any substance listed under Sections 3.135 or 3.140 of
17the Environmental Protection Act. "Coal tar pavement product"
18means a material that contains coal tar that is intended for
19use as a pavement sealant.
