2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Department of Central Management Services | ||||||||||||||||||||||||
5 | Law of the
Civil Administrative Code of Illinois is amended by | ||||||||||||||||||||||||
6 | changing Section 405-335 as follows: | ||||||||||||||||||||||||
7 | (20 ILCS 405/405-335) | ||||||||||||||||||||||||
8 | Sec. 405-335. Illinois Transparency and Accountability | ||||||||||||||||||||||||
9 | Portal (ITAP).
| ||||||||||||||||||||||||
10 | (a) The Department, within 12 months after the effective | ||||||||||||||||||||||||
11 | date of this amendatory Act of the 96th General Assembly, shall | ||||||||||||||||||||||||
12 | establish and maintain a website, known as the Illinois | ||||||||||||||||||||||||
13 | Transparency and Accountability Portal (ITAP), with a | ||||||||||||||||||||||||
14 | full-time webmaster tasked with compiling and updating the ITAP | ||||||||||||||||||||||||
15 | database with information received from all State agencies as | ||||||||||||||||||||||||
16 | defined in this Section. | ||||||||||||||||||||||||
17 | (b) For purposes of this Section: | ||||||||||||||||||||||||
18 | "State agency" means the offices of the constitutional | ||||||||||||||||||||||||
19 | officers identified in Article V of the Illinois Constitution, | ||||||||||||||||||||||||
20 | executive agencies, and departments, boards, commissions, and | ||||||||||||||||||||||||
21 | Authorities under the Governor. | ||||||||||||||||||||||||
22 | "Contracts" means payment obligations with vendors on file | ||||||||||||||||||||||||
23 | with the Office of the Comptroller to purchase goods and |

1 | services exceeding $10,000 in value (or, in the case of | ||||||
2 | professional or artistic services, exceeding $5,000 in value). | ||||||
3 | "Appropriation" means line-item detail of spending | ||||||
4 | approved by the General Assembly and Governor, categorized by | ||||||
5 | object of expenditure. | ||||||
6 | "Individual consultants" means temporary workers eligible | ||||||
7 | to receive State benefits paid on a State payroll. | ||||||
8 | "Recipients" means State agencies receiving | ||||||
9 | appropriations. | ||||||
10 | (c) The ITAP shall provide direct access to each of the | ||||||
11 | following: | ||||||
12 | (1) A database of all current State employees and | ||||||
13 | individual consultants, except sworn law enforcement | ||||||
14 | officers, sorted separately by: | ||||||
15 | (i) Name. | ||||||
16 | (ii) Employing State agency. | ||||||
17 | (iii) Employing State division. | ||||||
18 | (iv) Employment position title. | ||||||
19 | (v) Current pay rate and year-to-date pay. | ||||||
20 | (2) A database of all current State expenditures, | ||||||
21 | sorted separately by agency, category, recipient, and | ||||||
22 | Representative District. | ||||||
23 | (3) A database of all development assistance | ||||||
24 | reportable pursuant to the Corporate Accountability for | ||||||
25 | Tax Expenditures Act, sorted separately by tax credit | ||||||
26 | category, taxpayer, and Representative District. |

1 | (4) A database of all revocations and suspensions of | ||||||
2 | State occupation and use tax certificates of registration | ||||||
3 | and all revocations and suspensions of State professional | ||||||
4 | licenses, sorted separately by name, geographic location, | ||||||
5 | and certificate of registration number or license number, | ||||||
6 | as applicable. Professional license revocations and | ||||||
7 | suspensions shall be posted only if resulting from a | ||||||
8 | failure to pay taxes, license fees, or child support. | ||||||
9 | (5) A database of all current State contracts, sorted | ||||||
10 | separately by contractor name, awarding officer or agency, | ||||||
11 | contract value, and goods or services provided. | ||||||
12 | (6) A database of all employees hired after the | ||||||
13 | effective date of this amendatory Act of 2010, sorted | ||||||
14 | searchably by each of the following at the time of | ||||||
15 | employment: | ||||||
16 | (i) Name. | ||||||
17 | (ii) Employing State agency. | ||||||
18 | (iii) Employing State division. | ||||||
19 | (iv) Employment position title. | ||||||
20 | (v) Current pay rate and year-to-date pay. | ||||||
21 | (vi) County of employment location. | ||||||
22 | (vii) Rutan status. | ||||||
23 | (viii) Status of position as subject to collective | ||||||
24 | bargaining, subject to merit compensation, or exempt | ||||||
25 | under Section 4d of the Personnel Code. | ||||||
26 | (ix) Employment status as probationary, trainee, |

1 | intern, certified, or exempt from certification. | ||||||
2 | (x) Status as a military veteran. | ||||||
3 | (7) A database of the State's annual workforce | ||||||
4 | characteristics, workforce compensation, and employee | ||||||
5 | mobility, organized searchably by State agency, by job | ||||||
6 | classification, by union, and in aggregate, and including | ||||||
7 | the following information: | ||||||
8 | (i) the number of full-time, part-time, and | ||||||
9 | full-time equivalent employees; | ||||||
10 | (ii) the average length of employee service, | ||||||
11 | measured by the employee's total years in State | ||||||
12 | service, including years worked for another State | ||||||
13 | agency; | ||||||
14 | (iii) the number of employees for each job | ||||||
15 | classification; | ||||||
16 | (iv) total annual wages and salary, including | ||||||
17 | amounts paid per work hour, and the average annual | ||||||
18 | wages and salary per employee; | ||||||
19 | (v) total annual employer-paid benefits, including | ||||||
20 | benefits paid per work hour, and the average annual | ||||||
21 | employer-paid benefits per employee; | ||||||
22 | (vi) total annual compensation as measured by | ||||||
23 | wages, salaries, and employer-paid benefits combined, | ||||||
24 | including the total compensation paid per work hour, | ||||||
25 | the total annual compensation as a percentage of the | ||||||
26 | State budget, the total annual compensation as a |

1 | percentage of the State agency's budget, and the | ||||||
2 | average annual compensation per employee; | ||||||
3 | (vii) average annual sick days used per full-time | ||||||
4 | employee and the cost of the same per full-time | ||||||
5 | employee; | ||||||
6 | (viii) average annual vacation days used per | ||||||
7 | full-time employee and the cost of the same per | ||||||
8 | full-time employee; | ||||||
9 | (ix) average annual personal days used per | ||||||
10 | full-time employee and the cost of the same per | ||||||
11 | full-time employee; | ||||||
12 | (x) total overtime expenditures; | ||||||
13 | (xi) total overtime hours; | ||||||
14 | (xii) average annual employee turnover rate; | ||||||
15 | (xiii) total number of appointments; | ||||||
16 | (xiv) total number or terminations; | ||||||
17 | (xv) total number of separations, organized by the | ||||||
18 | cause of separation, including, but not limited to, | ||||||
19 | resignation, involuntary separation, and death; and | ||||||
20 | (xvi) total number of union employees. | ||||||
21 | (d) The ITAP shall include all information required to be | ||||||
22 | published by subsection (c) of this Section that is available | ||||||
23 | to the Department in a format the Department can compile and | ||||||
24 | publish on the ITAP. The Department shall update the ITAP as | ||||||
25 | additional information becomes available in a format that can | ||||||
26 | be compiled and published on the ITAP by the Department. |

1 | (e) Each State agency shall cooperate with the Department | ||||||
2 | in furnishing the information necessary for the implementation | ||||||
3 | of this Section within a timeframe specified by the Department. | ||||||
