AMENDMENT TO SENATE BILL 3724

2    AMENDMENT NO. ______. Amend Senate Bill 3724 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Energy Efficient Building Act is amended by
5changing Sections 10, 20, and 25 as follows:
 
6    (20 ILCS 3125/10)
7    Sec. 10. Definitions.
8    "Board" means the Capital Development Board.
9    "Building" includes both residential buildings and
10commercial buildings.
11    "Code" means the latest published edition of the
12International Code Council's International Energy Conservation
13Code as adopted by the Board, excluding published supplements
14but including the amendments and adaptations to the Code that
15are made by the Board.
16    "Commercial building" means any building except a building

1that is a residential building, as defined in this Section.
2    "Department" means the Department of Commerce and Economic
3Opportunity.
4    "Municipality" means any city, village, or incorporated
5town.
6    "Residential building" means (i) a detached one-family or
72-family dwelling or (ii) any building that is 3 stories or
8less in height above grade that contains multiple dwelling
9units, in which the occupants reside on a primarily permanent
10basis, such as a townhouse, a row house, an apartment house, a
11convent, a monastery, a rectory, a fraternity or sorority
12house, a dormitory, and a rooming house; provided, however,
13that when applied to a building located within the boundaries
14of a municipality having a population of 1,000,000 or more, the
15term "residential building" means a building containing one or
16more dwelling units, not exceeding 4 stories above grade, where
17occupants are primarily permanent.

20    Sec. 20. Applicability.
21    (a) Beginning January 1, 2012, the The Board shall review
22and adopt the Code within one year 9 months after its
23publication. The Code shall take effect within 6 3 months after
24it is adopted by the Board, except that the Code adopted in
252012 shall take effect on January 1, 2013, and shall apply to

1any new building or structure in this State for which a
2building permit application is received by a municipality or
3county, except as otherwise provided by this Act. In the case
4of any addition, alteration, renovation, or repair to an
5existing commercial structure, the Code adopted under this Act
6applies only to the portions of that structure that are being
7added, altered, renovated, or repaired. The changes made to
8this Section by this amendatory Act of the 97th General
9Assembly shall in no way invalidate or otherwise affect
10contracts entered into on or before the effective date of this
11amendatory Act of the 97th General Assembly.
12    (b) The following buildings shall be exempt from the Code:
13        (1) Buildings otherwise exempt from the provisions of a
14    locally adopted building code and buildings that do not
15    contain a conditioned space.
16        (2) Buildings that do not use either electricity or
17    fossil fuel for comfort conditioning. For purposes of
18    determining whether this exemption applies, a building
19    will be presumed to be heated by electricity, even in the
20    absence of equipment used for electric comfort heating,
21    whenever the building is provided with electrical service
22    in excess of 100 amps, unless the code enforcement official
23    determines that this electrical service is necessary for
24    purposes other than providing electric comfort heating.
25        (3) Historic buildings. This exemption shall apply to
26    those buildings that are listed on the National Register of

1    Historic Places or the Illinois Register of Historic
2    Places, and to those buildings that have been designated as
3    historically significant by a local governing body that is
4    authorized to make such designations.
5        (4) (Blank).
6        (5) Other buildings specified as exempt by the
7    International Energy Conservation Code.
8    (c) Additions, alterations, renovations, or repairs to an
9existing building, building system, or portion thereof shall
10conform to the provisions of the Code as they relate to new
11construction without requiring the unaltered portion of the
12existing building or building system to comply with the Code.
13The following need not comply with the Code, provided that the
14energy use of the building is not increased: (i) storm windows
15installed over existing fenestration, (ii) glass-only
16replacements in an existing sash and frame, (iii) existing
17ceiling, wall, or floor cavities exposed during construction,
18provided that these cavities are filled with insulation, and
19(iv) construction where the existing roof, wall, or floor is
20not exposed.
21    (d) A unit of local government that does not regulate
22energy efficient building standards is not required to adopt,
23enforce, or administer the Code; however, any energy efficient
24building standards adopted by a unit of local government must
25comply with this Act. If a unit of local government does not
26regulate energy efficient building standards, any

1construction, renovation, or addition to buildings or
2structures is subject to the provisions contained in this Act.

5    Sec. 25. Technical assistance.
6    (a) The Department shall make available to builders,
7designers, engineers, and architects implementation materials
8and training to that explain the requirements of the Code and
9describe methods of compliance acceptable to Code Enforcement
10Officials.
11    (b) The materials shall include software tools, simplified
12prescriptive options, and other materials as appropriate. The
13simplified materials shall be designed for projects in which a
14design professional may not be involved.
15    (c) The Department shall provide local jurisdictions with
16technical assistance concerning implementation and enforcement
17of the Code.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
