AMENDMENT TO HOUSE BILL 140

2    AMENDMENT NO. ______. Amend House Bill 140 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Employees Group Insurance Act of 1971
5is amended by adding Sections 2.5, 2.6, 2.7, and 2.8 as
6follows:
 
7    (5 ILCS 375/2.5 new)
8    Sec. 2.5. Application to Regional Transportation Authority
9Board members. Notwithstanding any other provision of this Act
10to the contrary, this Act does not apply to any member of the
11Regional Transportation Authority Board with respect to
12service on that Board during a term of office that begins on or
13after the effective date of this amendatory Act of the 98th
14General Assembly.

2    Sec. 22-105. Application to Regional Transportation

3    Section 15. The Metropolitan Transit Authority Act is
4amended by changing Sections 19 and 22 as follows:

6    Sec. 19. Compensation; pension; benefits.
7    (a) The governing and administrative body of the Authority
8shall be a board consisting of seven members, to be known as
9Chicago Transit Board. Members of the Board shall be residents
10of the metropolitan area and persons of recognized business
11ability. No member of the Board of the Authority shall hold any
12other office or employment under the Federal, State or any
13County or any municipal government except an honorary office
14without compensation or an office in the National Guard. No
15employee of the Authority shall hold any other office or
16employment under the Federal, State or any County or any
17municipal government except an office with compensation not
18exceeding $15,000 annually or a position in the National Guard
19or the United States military reserves. Provided, however, that
20the Chairman may be a member of the Board of the Regional
21Transportation Authority. No member of the Board or employee of
22the Authority shall have any private financial interest, profit
23or benefit in any contract, work or business of the Authority
24nor in the sale or lease of any property to or from the

1Authority.
2    (b) The provisions of this subsection (b) apply only for
3terms of office beginning before the effective date of this
4amendatory Act of the 98th General Assembly. The salary of each
5member of the initial Board shall be $15,000.00 per annum, and
6such salary shall not be increased or diminished during his or
7her term of office. The salaries of successor members of the
8Board shall be fixed by the Board and shall not be increased or
9diminished during their respective terms of office. No Board
10member shall be allowed any fees, perquisites or emoluments,
11reward or compensation for his or her services as a member or
12officer of the Authority aside from his or her salary or
13pension, but he or she shall be reimbursed for actual expenses
14incurred by him or her in the performance of his or her duties.
15    (c) For terms of office beginning on or after the effective
16date of this amendatory Act of the 98th General Assembly, each
17member of the Board shall be compensated $500 for attendance at
18each meeting of the Board and each other meeting he or she is
19statutorily required to attend in his or her capacity as a
20member of the Board, and for actual expenses incurred in travel
21to and from those meetings, but he or she shall not be
22otherwise compensated for service as a member of the Board.
23    For individuals who first become members of the Board on or
24after the effective date of this amendatory Act of the 98th
25General Assembly, no service or contribution shall be credited
26in any retirement system or pension fund, under the Illinois

1Pension Code or otherwise, for service on the Board, and no
2public funds shall be appropriated, expended, or otherwise
3obligated for such a retirement system or pension fund credit.
4For terms of office beginning on or after the effective date of
5this amendatory Act of the 98th General Assembly, neither the
6chairperson nor any other member of the Board shall be entitled
7to participate in a program of life or health insurance as a
8consequence of his or her service on the Board.

11    Sec. 22. Chairperson; terms; compensation. As soon as
12possible after the appointment of the initial members, the
13board shall organize for the transaction of business, select a
14chairman and a temporary secretary from its own number, and
15adopt by-laws, rules and regulations to govern its proceedings.
16The initial chairman and successors shall be elected by the
17Board from time to time for the term of his or her office as a
18member of the Board or for the term of three years, whichever
19is shorter.
20    The Board shall fix the salary of the chairperson chairman
21in addition to his salary as a member of the Board, which shall
22not be increased or diminished during his or her term of office
23as chairperson chairman. But if the chairperson chairman is
24engaged in any other business or employment during his or her

2    For individuals who first become a member of the Board on
3or after the effective date of this amendatory Act of the 98th
4General Assembly, no service or contribution shall be credited

7public funds shall be appropriated, expended, or otherwise
8obligated for such a retirement system or pension fund credit.
9For terms of office beginning on or after the effective date of
10this amendatory Act of the 98th General Assembly, neither the
11chairperson nor any other member of the Board shall be entitled
12to participate in a program of life or health insurance as a
13consequence of his or her service on the Board.

15    Section 25. The Regional Transportation Authority Act is
16amended by changing Sections 2.17, 3.04, 3A.06, and 3B.06 as
17follows:

19    Sec. 2.17. Employee Pensions.
20    (a) The Authority may establish and maintain systems of
21pensions and retirement benefits for such officers and
22employees of the Authority as may be designated or described by
23ordinance of the Authority; may fix the classifications
24therein; may take such steps as may be necessary to provide

1that persons eligible for admission to such pension systems as
2officers and employees of the Authority or of any
3transportation agency whose operations are financed in whole or
4in part by the Authority, shall retain eligibility for
5admission to or continued coverage and participation under
6Title II of the federal Social Security Act, as amended, and
7the related provisions of the Federal Insurance Contributions
8Act, as amended, or the federal Railroad Retirement Act, as
9amended, and the related provisions of the Railroad Retirement
10Tax Act, as amended, as the case may be; and may provide in
11connection with such pension systems, a system of benefits
12payable to the beneficiaries and dependents of any participant
13in such pension systems after the death of such participant
14(whether accidental or otherwise, whether occurring in the
15actual performance of duty or otherwise, or both) subject to
16such exceptions, conditions, restrictions and classifications
17as may be provided by ordinance of the Authority. Such pension
18systems shall be financed or funded by such means and in such
19manner as may be determined by the Authority to be economically
20feasible.
21    (b) Beginning on the effective date of this amendatory Act
22of the 98th General Assembly, the Authority shall not grant any
23new benefit increase. As used in this subsection (b), "new
24benefit increase" means (i) an increase in the amount of any
25benefit provided under the authority of an ordinance adopted
26under this Section that takes effect after the effective date

1of this amendatory Act of the 98th General Assembly and (ii) an
2expansion of the conditions of eligibility for any benefit
3provided under the authority of an ordinance adopted under this
4Section that takes effect after the effective date of this
5amendatory Act of the 98th General Assembly.

8    Sec. 3.04. Compensation; pension; benefits. For terms of
9office beginning prior to the effective date of this amendatory

13Authority, shall be compensated at the rate of $25,000 per

23Director, and for actual expenses incurred in travel to and
24from those meetings, but he or she shall not be otherwise

2date of this amendatory Act of the 98th General Assembly, the
3Chairman of the Chicago Transit Authority shall not be

6after the effective date of this amendatory Act of the 98th
7General Assembly, no service or contribution shall be credited
8in any retirement system or pension fund, under the Illinois
9Pension Code or otherwise, for service on the Board, and no
10public funds shall be appropriated, expended, or otherwise
11obligated for such a retirement system or pension fund credit.
12For terms of office beginning on or after the effective date of
13this amendatory Act of the 98th General Assembly, neither the
14Chairperson nor any other Director shall be entitled to
15participate in a program of life or health insurance as a
16consequence of his or her service on the Board.
17    Officers of the Authority shall not be required to comply
18with the requirements of the Public Funds Statement Publication
19Act "An Act requiring certain custodians of public moneys to
20file and publish statements of the receipts and disbursements
21thereof", approved June 24, 1919, as now or hereafter amended.

8for attendance at each meeting of the Board and each other
9meeting he or she is statutorily required to attend in his or
10her capacity as a member of the Suburban Bus Board, and for
11actual expenses incurred in travel to and from those meetings,
12but he or she shall not be otherwise compensated for service as
13a member of the Board. Each member shall be reimbursed for
14actual expenses incurred in the performance of his duties, not
15to exceed $5000 per year.
16    For individuals who first become members of the Board on or
17after the effective date of this amendatory Act of the 98th
18General Assembly, no service or contribution shall be credited
19in any retirement system or pension fund, under the Illinois
20Pension Code or otherwise, for service on that Board, and no
21public funds shall be appropriated, expended, or otherwise
22obligated for such a retirement system or pension fund credit.
23For terms of office beginning on or after the effective date of
24this amendatory Act of the 98th General Assembly, neither the
25Chairperson nor any other member of the Board shall be entitled
