| 1 | AMENDMENT TO HOUSE BILL 181

| 2 | AMENDMENT NO. ______. Amend House Bill 181 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Unified Code of Corrections is amended by | ||||||
| 5 | changing Section 5-9-1.14 as follows: | ||||||
| 6 | (730 ILCS 5/5-9-1.14) | ||||||
| 7 | Sec. 5-9-1.14. Additional child pornography fines. In | ||||||
| 8 | addition to any other penalty imposed, a fine of $500 shall be | ||||||
| 9 | imposed upon a person convicted of child pornography under | ||||||
| 10 | Section 11-20.1 of the Criminal Code of 1961 or the Criminal | ||||||
| 11 | Code of 2012. The Such additional fine shall be assessed by the | ||||||
| 12 | court imposing sentence and shall be collected by the circuit | ||||||
| 13 | clerk. Of this fee, $5 shall be deposited into the Circuit | ||||||
| 14 | Court Clerk Operation and Administrative Fund created by the | ||||||
| 15 | circuit clerk Clerk of the Circuit Court to be used to offset | ||||||
| 16 | the costs incurred by the circuit clerk Circuit Court Clerk in | ||||||
| |||||||
| |||||||
| 1 | performing the additional duties required to collect and | ||||||
| 2 | disburse funds to entities of State and local government as | ||||||
| 3 | provided by law. Each such additional fine shall be remitted by | ||||||
| 4 | the circuit clerk Circuit Court Clerk within one month after | ||||||
| 5 | receipt to the unit of local or State government whose law | ||||||
| 6 | enforcement officers investigated the case that gave rise to | ||||||
| 7 | the conviction of the defendant for child pornography. When | ||||||
| 8 | Department of State Police officers investigated the case that | ||||||
| 9 | gave rise to the conviction of the defendant for child | ||||||
| 10 | pornography, the additional fine shall be remitted by the | ||||||
| 11 | circuit clerk within one month after receipt to the State | ||||||
| 12 | Treasurer for deposit into the State Crime Laboratory Fund. | ||||||
| 13 | When the Department of State Police provides digital or | ||||||
| 14 | electronic forensic examination assistance, or both, to | ||||||
| 15 | another law enforcement agency which investigated the case that | ||||||
| 16 | gave rise to the conviction of the defendant for child | ||||||
| 17 | pornography, $100 of the additional fine shall be remitted by | ||||||
| 18 | the circuit clerk within one month after receipt to the State | ||||||
| 19 | Treasurer for deposit into the State Crime Laboratory Fund.
