AMENDMENT TO HOUSE BILL 1156

2    AMENDMENT NO. ______. Amend House Bill 1156, AS AMENDED, by
3inserting the following in its proper numeric sequence:
 
4    "Section 35. Possession prohibition exemption;
5registration.
6    (a) This Act does not apply to a person who possessed a
7prohibited assault weapon or assault weapon attachment before
8the effective date of this Act of the 98th General Assembly,
9provided the person has provided in a registration affidavit,
10under oath or affirmation and in the form and manner prescribed
11by the Department of State Police on or after 180 days after
12the effective date of this Act of the 98th General Assembly but
13within 300 days after the effective date of this Act:
14        (1) his or her name;
15        (2) his or her date of birth;
16        (3) his or her Firearm Owner's Identification Card
17    number;

1        (4) the make, model, caliber, and serial number of the
2    weapon or attachment; and
3        (5) proof of a locking mechanism that properly fits the
4    weapon.
5    (b) The affidavit shall include a statement that the weapon
6or assault weapon attachment is owned by the person submitting
7the affidavit and that he or she owns a proper locking
8mechanism for the weapon.
9    (c) The affidavit form shall include the following
10statement printed in bold type: "Warning: Entering false
11information on this form is punishable as perjury under Section
1232-2 of the Criminal Code of 2012."
13    (d) Beginning 300 days after the effective date of this Act
14of the 98th General Assembly, the person may transfer a
15registered assault weapon or assault weapon attachment to an
16heir, an individual residing in another state maintaining it in
17another state, or a dealer licensed as a federal firearms
18dealer under Section 923 of the federal Gun Control Act of
191968. Within 10 days after transfer of the weapon or attachment
20except to an heir, the person shall notify the Department of
21State Police of the name and address of the transferee and
22comply with the requirements of the Firearm Owners
23Identification Card Act. The person to whom the weapon is
24transferred may transfer it only as provided in this
25subsection.
26    (e) The Department of State Police shall implement this

1Section 180 after the effective date of this Act of the 98th
2General Assembly.".
