Amends the Illinois Municipal Code. Provides that a municipality may prohibit any electric generating wind device from locating less than 1,400 feet from a residence within its corporate limits. Further provides that a Section concerning wind energy systems shall apply only to devices permitted after the effective date of the amendatory Act. Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 11-42-15 as follows: |
6 | | (65 ILCS 5/11-42-15 new) |
7 | | Sec. 11-42-15. Wind energy systems. For electric |
8 | | generating wind devices other than those with a nameplate |
9 | | generating capacity of less than 100 kilowatts that are used |
10 | | primarily by an end user, a municipality may prohibit any |
11 | | electric generating wind device from locating less than 1,400 |
12 | | feet from a residence within its corporate limits, provided |
13 | | that the regulation is not inconsistent with another |
14 | | municipality's zoning regulation. This Section shall apply |
15 | | only to electric generating wind devices permitted after the |
16 | | effective date of this amendatory Act of the 98th General |
17 | | Assembly.

18 | | Section 99. Effective date. This Act takes effect upon |
19 | | becoming law.
