Amends the Illinois Vehicle Code. Authorizes the Secretary of State to issue Christopher Wheatley Memorial License Plates. Creates the Christopher Wheatley Memorial Foundation Fund and authorizes payments, subject to appropriation by the General Assembly and distribution by the Secretary of State, as grants to the Christopher D. Wheatley Memorial Foundation.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The State Finance Act is amended by adding |
5 | | Section 5.826 as follows: |

7 | | Sec. 5.826. The Christopher Wheatley Memorial Foundation |
8 | | Fund. |
9 | | Section 10. The Illinois Vehicle Code is amended by adding |
10 | | Section 3-699 as follows: |
11 | | (625 ILCS 5/3-699 new) |
12 | | Sec. 3-699. Christopher Wheatley Memorial License Plates. |
13 | | (a) The Secretary, upon receipt of all applicable fees and |
14 | | applications made in the form prescribed by the Secretary, may |
15 | | issue special registration plates designated as Christopher |
16 | | Wheatley Memorial license plates. The special plates issued |
17 | | under this Section shall be affixed only to passenger vehicles |
18 | | of the first division and motor vehicles of the second division |
19 | | weighing not more than 8,000 pounds. Plates issued under this |
20 | | Section shall expire according to the multi-year procedure |
21 | | established by Section 3-414.1 of this Code. |

1 | | (b) The design and color of the plates is wholly within the |
2 | | discretion of the Secretary of State. Appropriate |
3 | | documentation, as determined by the Secretary, shall accompany |
4 | | the application. The Secretary, in his or her discretion, may |
5 | | allow the plates to be issued as vanity or personalized plates |
6 | | under Section 3-405.1 of this Code. The Secretary shall |
7 | | prescribe stickers or decals as provided under Section 3-412 of |
8 | | this Code. |
9 | | (c) An applicant for the special plate shall be charged a |
10 | | $40 fee for original issuance in addition to the appropriate |
11 | | registration fee. Of this fee, $25 shall be deposited into the |
12 | | Christopher Wheatley Memorial Foundation Fund and $15 shall be |
13 | | deposited into the Secretary of State Special License Plate |
14 | | Fund, to be used by the Secretary to help defray the |
15 | | administrative processing costs. |
16 | | For each registration renewal period, a $25 fee, in |
17 | | addition to the appropriate registration fee, shall be charged. |
18 | | Of this fee, $23 shall be deposited into the Christopher |
19 | | Wheatley Memorial Foundation Fund and $2 shall be deposited |
20 | | into the Secretary of State Special License Plate Fund. |
21 | | (d) The Christopher Wheatley Memorial Foundation Fund is |
22 | | created as a special fund in the State treasury. All money in |
23 | | the Christopher Wheatley Memorial Foundation Fund shall be |
24 | | paid, subject to appropriation by the General Assembly and |
25 | | distribution by the Secretary, as grants to the Christopher D. |
26 | | Wheatley Memorial Foundation for the funding of scholarships.
