SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/14-6.07 new

    Amends the Children with Disabilities Article of the School Code. Provides that a medical review done as part of a special education evaluation may be performed by (1) a certified or licensed school nurse, (2) a physician licensed to practice medicine in all of its branches, or (3) a nurse who holds a bachelor's degree or higher and is licensed as a registered professional nurse or advanced practice nurse under the Nurse Practice Act, provided that only a certified or licensed school nurse may make recommendations regarding educational interventions, accommodations, or modifications based on the findings of a child's medical review. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
514-6.07 as follows:
 
6    (105 ILCS 5/14-6.07 new)
7    Sec. 14-6.07. Medical reviews.
8    (a) In this Section:
9    "Certified or licensed school nurse" means a nurse who is
10certified under Section 21-25 of this Code, holding a school
11service personnel certificate endorsed for school nursing
12pursuant to 23 Ill. Adm. Code 25.245, or a nurse who holds a
13Professional Educator License with a school support personnel
14endorsement for school nursing under Section 21B-25 of this
15Code and any related rules.
16    "Medical review" means a comprehensive review of a child's
17medical and health status to determine, as part of a special
18education evaluation, whether a health condition is adversely
19affecting the child's educational performance.
20    (b) Beginning July 1, 2013, a medical review may be
21performed by any of the following:
22        (1) A certified or licensed school nurse.
23        (2) A physician licensed to practice medicine in all of

1    its branches.
2        (3) A nurse who hold a bachelor's degree or higher and
3    a license issued under Article 60 or 65 of the Nurse
4    Practice Act.
5However, only a certified or licensed school nurse may make
6recommendations regarding educational interventions,
7accommodations, or modifications based on the findings of a
8child's medical review.
 
9    Section 99. Effective date. This Act takes effect upon
10becoming law.
