AMENDMENT TO HOUSE BILL 1711

2    AMENDMENT NO. ______. Amend House Bill 1711 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Municipal Code is amended by
5changing Section 3.1-15-25 as follows:
 
6    (65 ILCS 5/3.1-15-25)  (from Ch. 24, par. 3.1-15-25)
7    Sec. 3.1-15-25. Conservators of the peace; service of
8warrants.
9    (a) After receiving a certificate attesting to the
10successful completion of a training course administered by the
11Illinois Law Enforcement Training Standards Board, the mayor,
12aldermen, president, trustees, marshal, deputy marshals, and
13policemen in municipalities with a population of less than
141,000,000 shall be conservators of the peace. After receiving a
15certificate attesting to the successful completion of a
16training course administered by the Illinois Law Enforcement

1Training Standards Board, policemen in municipalities with a
2population of 1,000,000 or more shall be conservators of the
3peace. Conservators of the peace Those persons and others
4authorized by ordinance shall have power (i) to arrest or cause
5to be arrested, with or without process, all persons who break
6the peace or are found violating any municipal ordinance or any
7criminal law of the State, (ii) to commit arrested persons for
8examination, (iii) if necessary, to detain arrested persons in
9custody over night or Sunday in any safe place or until they
10can be brought before the proper court, and (iv) to exercise
11all other powers as conservators of the peace prescribed by the
12corporate authorities.
13    (b) All warrants for the violation of municipal ordinances
14or the State criminal law, directed to any person, may be
15served and executed within the limits of a municipality by any
16policeman or marshal of the municipality. For that purpose,
17policemen and marshals have all the common law and statutory
18powers of sheriffs.
