1 | | AN ACT concerning elections.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Election Code is amended by changing Section |
5 | | 28-8 as follows:
|
6 | | (10 ILCS 5/28-8) (from Ch. 46, par. 28-8)

7 | | Sec. 28-8. If a referendum held in accordance with Section |
8 | | 28-7 of this
Act involved
the question of whether a unit of |
9 | | local government shall
become a home rule unit or shall cease |
10 | | to be a home rule unit , the question shall be submitted in |
11 | | substantially the following form: |
12 | | Shall (name of the unit of local government) cease to be a |
13 | | home rule unit? |
14 | | Votes must be recorded as "yes" and "no". If a majority of |
15 | | the electors voting on the question vote in the affirmative and |
16 | | if that referendum passed , then the clerk
of that unit of local |
17 | | government shall, within 45
days after the
referendum,
file |
18 | | with the Secretary of State a certified
statement showing the |
19 | | results of the referendum and the resulting status
of the unit |
20 | | of local government as a home rule unit or a non-home rule
|
21 | | unit. The Secretary of State shall maintain such certified |
22 | | statements in
his office as a public record.
