    Amends the Criminal Code of 2012. Makes a technical change in a Section concerning contributing to the dependency and neglect of a minor.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by changing
5Section 12C-25 as follows:
 
6    (720 ILCS 5/12C-25)
7    Sec. 12C-25. Contributing to the dependency and neglect of
8a minor.
9    (a) Any Any parent, legal guardian or person having the
10custody of a child under the age of 18 years commits
11contributing to the dependency and neglect of a minor when he
12or she knowingly: (1) causes, aids, or encourages such minor to
13be or to become a dependent and neglected minor; (2) does acts
14which directly tend to render any such minor so dependent and
15neglected; or (3) fails to do that which will directly tend to
16prevent such state of dependency and neglect. It is not a
17violation of this Section for a person to relinquish a child in
18accordance with the Abandoned Newborn Infant Protection Act.
19    (b) "Dependent and neglected minor" means any child who,
20while under the age of 18 years, for any reason is destitute,
21homeless or abandoned; or dependent upon the public for
22support; or has not proper parental care or guardianship; or
23habitually begs or receives alms; or is found living in any

1house of ill fame or with any vicious or disreputable person;
2or has a home which by reason of neglect, cruelty or depravity
3on the part of its parents, guardian or any other person in
4whose care it may be is an unfit place for such child; and any
5child who while under the age of 10 years is found begging,
6peddling or selling any articles or singing or playing any
7musical instrument for gain upon the street or giving any
8public entertainments or accompanies or is used in aid of any
9person so doing.
10    (c) Sentence. A violation of this Section is a Class A
11misdemeanor.
12    (d) The husband or wife of the defendant shall be a
13competent witness to testify in any case under this Section and
14to all matters relevant thereto.
