SYNOPSIS AS INTRODUCED:
 
230 ILCS 40/28 new

    Amends the Video Gaming Act. Provides that the governing body of a municipality or a county board of a county in which video gaming has not been prohibited may pass an ordinance to (1) limit the number of video gaming terminals permitted to operate within the boundaries of the municipality or the unincorporated areas of the county and (2) place restrictions on the locations of the video gaming terminals within the boundaries of the municipality or the unincorporated areas of the county, including, but not limited to, requiring a mandatory distance in feet between sets of video gaming terminals. Effective immediately.

1    AN ACT concerning gaming.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Video Gaming Act is amended by adding
5Section 28 as follows:
 
6    (230 ILCS 40/28 new)
7    Sec. 28. Local ordinances. The governing body of a
8municipality or a county board of a county in which video
9gaming has not been prohibited pursuant to Section 27 or 70 of
10this Act may pass an ordinance to (1) limit the number of video
11gaming terminals permitted to operate within the boundaries of
12the municipality or the unincorporated areas of the county and
13(2) place restrictions on the locations of the video gaming
14terminals within the boundaries of the municipality or the
15unincorporated areas of the county, including, but not limited
16to, requiring a mandatory distance in feet between sets of
17video gaming terminals.
18    An ordinance adopted under this Section shall not conflict
19with the powers and duties of the Illinois Gaming Board.
20    Nothing in this Section shall be construed to grant
21authority to any entity to operate a video gaming terminal
22without a license under this Act.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
