AMENDMENT TO HOUSE BILL 3359

2    AMENDMENT NO. ______. Amend House Bill 3359 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Pawnbroker Regulation Act is amended by
5adding Section 20 as follows:
 
6    (205 ILCS 510/20 new)
7    Sec. 20. Precious Metal Purchasers Task Force.
8    (a) The General Assembly finds:
9        (1) There has been, and continues to be, a significant
10    expansion in the volume of precious metals and jewelry sold
11    through pawnbrokers, auction services, for-profit
12    consignment sellers, and other resellers.
13        (2) There has been, and continues to be, a similar
14    increase in the volume of stolen precious metals and
15    jewelry.
16        (3) Access by law enforcement to sales-related

1    information generated by pawnbrokers, auction services,
2    for-profit consignment sellers, and other resellers has
3    always been an important tool in combating burglary,
4    robbery, theft, and other crimes directed at personal
5    property.
6        (4) Recent advances in electronic data collection and
7    compilation have greatly simplified both the reporting of
8    sales-related information by pawnbrokers, auction
9    services, for-profit consignment sellers, and other
10    resellers.
11        (5) Law enforcement agencies, pawnbrokers, auction
12    services, for-profit consignment sellers, resellers, and
13    information technology-related businesses in several
14    states have created differing systems to provide law
15    enforcement with timely access to sales-related
16    information.
17    (b) There is hereby created the Precious Metal Purchasers
18Task Force, consisting of members appointed as follows:
19        (1) two members from the Senate, one appointed by the
20    Senate President and one appointed by the Minority Leader;
21        (2) two members from the House of Representatives, one
22    appointed by the Speaker of the House and one appointed by
23    the Minority Leader;
24        (3) one member appointed by the Governor as chairperson
25    of the task force;
26        (4) one member appointed by the Secretary of State;

1        (5) one member appointed by the Attorney General;
2        (6) one member appointed by the Secretary of Financial
3    and Professional Regulation from the Department of
4    Financial and Professional Regulation;
5        (7) one member appointed by the Director of State
6    Police from the Department of State Police;
7        (8) one member from a statewide organization
8    representing the Chiefs of Police appointed by the
9    Governor;
10        (9) one member recommended by the Illinois Municipal
11    League and appointed by the Governor;
12        (10) one member representing the interests of
13    pawnbrokers appointed by the Governor;
14        (11) one member representing the interests of
15    for-profit consignment shops appointed by the Governor;
16        (12) one member representing the interests of the
17    insurance industry with a strong vested interest in
18    stopping theft and recovering stolen goods appointed by the
19    Governor; and
20        (13) two member representing the interests of the
21    general public appointed by the Governor.
22    All members appointed under this Section shall serve
23without compensation, and may be reimbursed for their
24reasonable and necessary expenses from funds appropriated from
25the Pawnbroker Regulation Fund.
26    (c) The task force shall study the various systems,

1technologies, and methods of operation for providing law
2enforcement with the timely access to information relating to
3the sales of precious metals and jewelry by pawnbrokers,
4auction sellers, for-profit consignment sellers, resellers,
5and other persons or entities as it may deem fit, including,
6but not limited to, providers of technology and services
7relating to the collection, compilation, storage, and access to
8such information.
9    (d) The Department of Financial and Professional
10Regulation shall provide any necessary administrative and
11other support to the task force.
12    (e) On or before December 31, 2013, the task force shall
13file and present a report to the General Assembly concerning
14its recommendations regarding the systems and technologies,
15together with their usage and potential funding mechanisms and
16sources, to be implemented to create a statewide system for the
17collection of information of the sales of precious metals and
18jewelry by pawnbrokers, auction services, for-profit
19consignment sellers, and other resellers, and for the
20compilation, storage, and timely access to that information by
21law enforcement and shall include proposed legislation to
22implement its recommendations, if needed.
23    (f) This Section is repealed on December 31, 2014.".
 
24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
