Amends the General Assembly Compensation Act. Provides that, for terms commencing on or after January 14, 2015, each member of the General Assembly shall receive compensation that is no more than 90% of the amount last set by the Compensation Review Board. Amends the Compensation Review Act. For fiscal year 2014 and each fiscal year thereafter, prohibits a cost of living adjustment for General Assembly members. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The General Assembly Compensation Act is amended |
5 | | by changing Section 1 as follows: |
6 | | (25 ILCS 115/1) (from Ch. 63, par. 14) |
7 | | Sec. 1. Annual salary; stipends; travel reimbursement. For |
8 | | terms commencing before January 14, 2015, each Each member of |
9 | | the General Assembly shall receive an annual salary
of $28,000 |
10 | | or as set by the Compensation Review Board, whichever is
|
11 | | greater. For terms commencing on or after January 14, 2015, |
12 | | each member of the General Assembly shall receive an annual |
13 | | salary that is no more than 90% of the amount last set by the |
14 | | Compensation Review Board. The
following named officers, |
15 | | committee chairmen and committee minority spokesmen
shall |
16 | | receive additional amounts per year for
their services as such |
17 | | officers, committee chairmen and committee
minority spokesmen |
18 | | respectively, as set by the Compensation
Review Board or, as |
19 | | follows, whichever is greater: Beginning the second
Wednesday |
20 | | in January 1989, the Speaker and the minority leader of the

shall receive only one additional amount based on the |
20 | | position paying the
highest additional amount. The

21 | | compensation provided for in this Section to be paid per year |
22 | | to members
of the General Assembly, including the additional |
23 | | sums payable per year
to officers of the General Assembly shall |
24 | | be paid in 12 equal monthly
installments. The first such |
25 | | installment is payable on January 31,
1977. All subsequent |
26 | | equal monthly installments are payable on the last
working day |

1 | | of the month. A member who has held office any part of a
month |
2 | | is entitled to compensation for an entire month. |
3 | | Mileage shall be paid at the rate of 20 cents per mile |
4 | | before January
9, 1985, and at the mileage allowance rate in |
5 | | effect under regulations
promulgated pursuant to 5 U.S.C. |
6 | | 5707(b)(2) beginning January 9, 1985, for the number
of actual |
7 | | highway miles necessarily and conveniently traveled by the
most |
8 | | feasible route to be present upon convening of the sessions of |
9 | | the
General Assembly by such member in each and every trip |
10 | | during each
session in going to and returning from the seat of |
11 | | government, to be
computed by the Comptroller. A member |
12 | | traveling by public
transportation for such purposes, however, |
13 | | shall be paid his or her actual cost
of that transportation |
14 | | instead of on the mileage rate if his or her cost of
public |
15 | | transportation exceeds the amount to which he would be entitled
|
16 | | on a mileage basis. No member may be paid, whether on a mileage |
17 | | basis
or for actual costs of public transportation, for more |
18 | | than one such
trip for each week the General Assembly is |
19 | | actually in session. Each
member shall also receive an |
20 | | allowance of $36 per day for lodging and
meals while in |
21 | | attendance at sessions
of the General Assembly before January |
22 | | 9, 1985; beginning January 9,
1985, such food and lodging |
23 | | allowance shall be equal to the amount per day
permitted to be |
24 | | deducted for such expenses under the Internal Revenue Code;

25 | | however, beginning May 31, 1995, no allowance for food and |
26 | | lodging while in
attendance at sessions is authorized for |
|

1 | | periods of time after the last day in
May of each calendar |
2 | | year, except (i) if the General Assembly is convened in
special |
3 | | session by either the Governor or the presiding officers of |
4 | | both
houses, as provided by subsection (b) of Section 5 of |
5 | | Article IV of the
Illinois Constitution or (ii) if the
General |
6 | | Assembly is convened to consider bills vetoed, item vetoed, |
7 | | reduced, or
returned with specific recommendations for change |
8 | | by the Governor as provided
in Section 9 of Article IV of the |
9 | | Illinois Constitution. For fiscal year 2011 and for session |
10 | | days in fiscal years 2012 and 2013 only (i) the allowance for |
11 | | lodging and meals is $111 per day and (ii) mileage for |
12 | | automobile travel shall be reimbursed at a rate of $0.39 per |
13 | | mile. |
14 | | Notwithstanding any other provision of law to the contrary, |
15 | | beginning in fiscal year 2012, travel reimbursement for

16 | | Assembly members on non-session days shall be
calculated using |
17 | | the guidelines set forth by the Legislative
Travel Control |
18 | | Board, except that fiscal year 2012 and 2013 mileage |
19 | | reimbursement is set at a rate of $0.39 per mile. |
20 | | If a member dies having received only a portion of the |
21 | | amount payable
as compensation, the unpaid balance shall be |
22 | | paid to the surviving
spouse of such member, or, if there be |
23 | | none, to the estate of such member. |

2 | | changing Sections 5.8 and 5.9 and adding Section 5.10 as |
3 | | follows: |

5 | | Sec. 5.8. FY12 COLAs prohibited. Notwithstanding any |
6 | | former or current provision of this Act, any other law, any |
7 | | report of the Compensation Review Board, or any resolution of |
8 | | the General Assembly to the contrary, members of the General |
9 | | Assembly, State's attorneys, other than the county supplement, |
10 | | elected executive branch constitutional officers of State |
11 | | government, and persons in certain appointed offices of State |
12 | | government, including the membership of State departments, |
13 | | agencies, boards, and commissions, whose annual compensation |
14 | | previously was recommended or determined by the Compensation |
15 | | Review Board, are prohibited from receiving and shall not |
16 | | receive any increase in compensation that would otherwise apply |
17 | | based on a cost of living adjustment, as authorized by Senate |
18 | | Joint Resolution 192 of the 86th General Assembly, for or |
19 | | during the fiscal year beginning July 1, 2011. That cost of |
20 | | living adjustment shall apply again in the fiscal year |
21 | | beginning July 1, 2012 and thereafter.
