AMENDMENT TO HOUSE BILL 3768

2    AMENDMENT NO. ______. Amend House Bill 3768 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Humane Care for Animals Act is amended by
5changing Section 3.01 as follows:
 
6    (510 ILCS 70/3.01)  (from Ch. 8, par. 703.01)
7    Sec. 3.01. Cruel treatment. No person or owner may beat,
8cruelly treat, torment, starve, overwork or otherwise abuse any
9animal.
10    No owner may abandon any animal where it may become a
11public charge or may suffer injury, hunger or exposure.
12    Except as otherwise provided, a A person convicted of
13violating this Section is guilty of a Class A misdemeanor. A
14second or subsequent conviction for a violation of this Section
15is a Class 4 felony. In addition to any other penalty provided
16by law, upon conviction for violating this Section, the court

1may order the convicted person to undergo a psychological or
2psychiatric evaluation and to undergo any treatment at the
3convicted person's expense that the court determines to be
4appropriate after due consideration of the evidence. If a
5person convicted of violating this Section committed the act in
6the presence of a minor, he or she is guilty of a Class 4 felony
7for the first violation and a Class 3 felony for a second or
8subsequent violation. If the convicted person is a juvenile or
9a companion animal hoarder, the court must order the convicted
10person to undergo a psychological or psychiatric evaluation and
11to undergo treatment that the court determines to be
12appropriate after due consideration of the evaluation.
